4 yearly review of modern awards – Nurses Award 2010 – substantive issues – correction determination.

A. Further to the decisions issued by the Fair Work Commission on 9 January 2019 [2019] FWCFB 121 and on 21 February 2019 [2019] FWCFB 1123, the determination issued on 9 January 2019 [PR703715] is corrected as follows:

1. By deleting item A.7 and inserting the following:

“7. By renumbering clauses 28.6(b) to 28.6(d) as clauses 28.6(c) to 28.6(e).”

2. By renumbering item A.8 as item A.9.

3. By inserting a new item A.8 as follows:

“8. By inserting a new clause 28.6(b) as follows:

(b) An employee who is not required to be on call and who is required to perform work by the employer via telephone and other electronic communication away from the workplace will be paid at the appropriate overtime rate for a minimum of one hours work. Multiple electronic requests made and concluded within the same hour shall be compensated within the same one hour’s overtime payment. Time worked beyond one hour will be rounded to the nearest 15 minutes.”

B. This determination comes into operation from 21 February 2019. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect until the start of the first full pay period that starts on or after the date of operation.
