4 yearly review of modern awards – Sugar Industry Award 2010 – modern award varied – correction.

A. The determination issued by the Full Bench on 30 April 2020 [PR718542] and the determination issued on 16 June 2020 [PR720173] are corrected as follows:

1. By deleting the fourth column of the table appearing at clause D.2.5 of the attachment to the determination published 16 June 2020.

2. By inserting footnote 1 next to the word “Overtime” appearing in the third column of the table at clauses D.3.1 and D.3.4 of the attachment to the determination published 16 June 2020.

3. By inserting the words “Outside the spread of 6.00 am to 6.00 pm.” as footnote 1 appearing under the table at clauses D.3.1 and D.3.4 of the attachment to the determination published 16 June 2020.

4. By deleting the words “Table 4—Wage level B minimum weekly rate for full-time trainees (AQF Certificate Level IV traineeship)” in clause H.4.1(d)(ii) of the attachment to the determination published 16 June 2020 and inserting the words “Table 4—Minimum weekly rate for full-time adult trainees (AQF Certificate Level IV traineeship)”.

5. By deleting the words “Table 4—Wage level B minimum weekly rate for full-time trainees (AQF Certificate Level IV traineeship)” appearing as a heading to the table at clause H.4.1(d)(ii) of the attachment to the determination published 16 June 2020 and inserting the words “Table 4—Minimum weekly rate for full-time adult trainees (AQF Certificate Level IV traineeship)”.

6. By deleting the words “Table 5—Wage level B minimum hourly rate for part-time trainees (AQF Certificate Level I–III traineeship” in clause H.4.2(a) of the attachment to the determination published 16 June 2020 and inserting the words “Table 5—Wage level A minimum hourly rate for part-time trainees (AQF Certificate Level I–III traineeship)”.

7. By deleting the words “Table 7—Wage level B minimum hourly rate for part-time trainees (AQF Certificate Level I–II traineeship” in clause H.4.2(c) of the attachment to the determination published 16 June 2020 and inserting the words “Table 7—Wage level C minimum hourly rate for part-time trainees (AQF Certificate Level I–III traineeship)”.

8. By deleting the words “Table 7—Wage level B minimum hourly rate for part-time trainees (AQF Certificate Level I–II traineeship” appearing as a heading to the table at clause H.4.2(c) of the attachment to the determination published 16 June 2020 and inserting the words “Table 7—Wage level C minimum hourly rate for part-time trainees (AQF Certificate Level I–III traineeship)”.

9. By updating the table of contents and cross references accordingly.

B. This determination comes into operation from 18 June 2020. In accordance with s.165(3) of the Fair Work Act 2009, this determination does not take effect until the start of the first full pay period that starts on or after 18 June 2020.
