AN160741 – Coal Mining Industry (Engineers) Award 1990

5. - DEFINITIONS

In this award the following terms shall be defined as shown:-

"Act"

means the Western Australian Coal Industry Tribunal Act as amended.

"Advanced Tradesperson Level 1"

means a tradesperson who has successfully completed the 1st year of an Advanced Certificate or of an Associate Diploma.

"Advanced Tradesperson Level 2"

means a tradesperson who has successfully completed an Advanced Certificate or the 2nd year of an Associate Diploma (Advanced Trade).

"Casual Employee"

means an employee whose engagement is terminated before the expiration of 6 consecutive working days. In construing the term "working days!" days upon which employees under this Award do not usually work shall be excluded, except work which is actually done by the employee engaged, in which case such day shall count as part of the 6 consecutive working days. A casual employee shall be paid at the rate of 20 per cent in addition to the rates prescribed in the Wage Schedules.

"Deputy"

shall mean a person appointed to such statutory designation as prescribed by and under the provisions of the Coal Mines Regulation Act, who, in addition to the duties and requirements prescribed by and under such Act performs other duties relative to the proper and efficient operations of a mine and supervision of the workforce as assigned by the Manager.

"Experienced Tradesperson"

means a tradesperson having had not less than two years on-the-job experience in the coal mining industry at Collie.

"Industry"

for the purpose of this award means the Coal Mining Industry in Western Australia and includes all work carried out by employees engaged by the employers in or in connection with the preparation for and the mining of coal, within the mining leases and tenements of the employers or at their offices in the town from which the mining operations are conducted.

"Linesperson"

shall mean an employee engaged (with or without assistance) on erecting poles for electrical wires, cables and other conductors or erecting wires, cables or other conductors on poles on or over buildings or tying them to insulators or joining or insulating them or doing any work on electrical poles off the ground.

"Manager"

the term "Manager" or "Management" shall mean the mine or other relevant manager and/or subordinate officials having for the time being the authority of management.

"Millwright"

for the purpose of this award means and includes an employee employed in the Coal Mining Industry as a tradesperson carpenter and or joiner, skip repairer, plumber, painter (other than a brush hand) or bricklayer provided that nothing herein shall prevent the carrying out of any work by members of another Union which has been customarily performed by such employees at the rate of wage usually received by them under the provisions of their respective awards, and shall include overcasts, retaining walls, bridges and stopping underground erected by members of the Miners' Union.

"Ordinary Rate, or Ordinary Rate of Pay"

means the employee's base rate of pay for the appropriate classification plus any experience allowance set out in the Wage Schedules.

"Rostered Hours"

means the hours of a shift allocated to an employee in accordance with the work roster established at each mine site or work place.

"Special Class Tradesperson"

means a tradesperson who has completed an appropriate Post Trade Certificate.

"Tradesperson Level 1"

means a tradesperson who holds a Trade Certificate or Tradespersons Rights Certificate as an:
Engineering Tradesperson (electrical/electronic) level 1; or
Engineering Tradesperson (mechanical) Level 1; or
Engineering Tradesperson (fabrication) Level 1; and is able to exercise the skills and knowledge of that trade.

"Tradesperson Level 2"

means a tradesperson who has completed 33% of the modules towards an appropriate Post Trade Certificate.

"Tradesperson Level 3"

means a tradesperson who has completed 66% of the modules towards an appropriate Post Trade Certificate.

"Tribunal"

means the Western Australia Coal Industry Tribunal.

"Union"

means the Metal and Engineering Workers' Union or the Australian Electrical Electronics, Foundry and Engineering Union WA Branch.
