STATEMENT

[1] We refer to the statement and directions issued on 27 April 2010.

[2] The Australian Federation of Employers and Industries (AFEI) has expressed concern that the dates fixed for filing outlines of contentions, evidence and other material may operate to disadvantage those opposing the ASU’s claim. AFEI is concerned that there is a common filing date for all parties other than the ASU, and that a number of parties support the ASU claim.

[3] We do not propose to alter the directions made on 27 April 2010. We make it plain, however, that all parties are entitled to an adequate opportunity to meet the case against them. Any party wishing to file further contentions, evidence or other material may make an application prior to the mention on 13 August 2010. Any such application will be dealt with at the mention.
