As a result of the JobKeeper scheme, there are new workplace rights relating to JobKeeper directions and agreements. These workplace rights are protected under the general protections provisions of the Fair Work Act 2009.
The new workplace rights relate to:
- the obligation of the employer to satisfy the wage condition
- agreeing, or not agreeing, to perform duties on different days or at different times
- agreeing or not agreeing to take paid annual leave
- making a request for secondary employment or training
A person must not take adverse action against another person because the other person has a workplace right or exercises or proposes to exercise a workplace right.
