Under the Fair Work Act 2009, the Commission must ensure that all persons and bodies have a reasonable opportunity to provide comment on submissions. Submissions in reply are invited from interested parties including individuals, organisations and academics.
The closing date for lodging written submissions in reply and any other submissions relating to data published after 30 March 2016 is 5.00 pm (AEST) 15 April 2016.
Submissions in reply and submissions related to data published after 30 March 2016 should include the reply and any other data cover sheet and may be lodged in the same way as submissions outlined above.
The 2016–17 Commonwealth Budget is expected to be handed down on the second Tuesday of May, 10 May 2016, consistent with past practice. Written supplementary submissions limited to matters relevant to the Budget are invited.
The closing date for lodging written post-Budget submissions is 5 pm (AEST) on 13 May 2016.
Post-Budget submissions should include the post-Budget cover sheet and may be lodged in the same way as submissions outlined above.
The Commission, under s.289 of the Fair Work Act 2009, is required to publish all submissions made to Annual Wage Reviews.
However, if a submission made by a person or body includes information that is claimed to be confidential or commercially sensitive, and the Fair Work Commission is satisfied that the information is confidential or commercially sensitive, the Commission:
(a) may decide not to publish the information, and
(b) may instead publish:
(i) a summary of the information which contains sufficient detail to allow a reasonable understanding of the substance of the information (without disclosing anything that is confidential or commercially sensitive), or
(ii) if the Commission considers that it is not practicable to prepare a summary that would comply with subparagraph (i)—a statement that confidential or commercially sensitive information in the submission has not been published.
