1 APPLICATION OF APPENDIX A

Subject to the exceptions and modifications contained in this Appendix, the conditions of employment and classifications of all persons employed as exhibition workers as defined in this Appendix, whether members of a union or not and in the employ of National Exhibitions Adelaide Pty. Ltd., shall be as prescribed in the award.

The parties to this Appendix shall be National Exhibitions Adelaide Pty. Ltd., the Amalgamated Society of Carpenters and Joiners of Australia (South Australian Branch) and the Construction, Forestry, Mining and Energy Union (South Australian Branch).

2 DEFINITIONS

(a) Exhibition Worker Grade I

(i) Under supervision, erects and dismantles and handles exhibition components at an exhibition venue as directed but is not required to read plans.

(ii) Under supervision, carries out duties at the company's premises as directed.

(iii) Without supervision, loads and unloads company transport vehicles with materials and drives company vehicle to and from exhibition venues.

(b) Exhibition Worker Grade II

(i) Carries out proficiently the duties of Exhibition
Worker Grade I.

(ii) Read less complex plans for the purpose of erecting exhibition structures involving standard components.

(iii) Carries out tasks at an exhibition venue or the company's premises without direct supervision.

(iv) Other duties as directed e.g. materials maintenance.

(c) Exhibition Worker Grade III

(i) Carries out proficiently the duties of Exhibition
Worker Grade II.

(ii) Reads and interprets all plans involving standard components and following briefing those plans involving non-standard components or more complex plans.

(iii) Supervises Exhibition Worker Grades I and II.

(iv) Other duties as directed e.g. materials maintenance.

(d) Exhibition Venue

An exhibition venue is any venue where an exhibition or promotional activity is held.

(e) Company's Premises

The Company's premises shall mean the registered premises of National Exhibitions Adelaide Pty. ltd.

(f) Composite Wage Rate

A composite wage rate shall apply, based on the rates set in this Appendix, and shall be in lieu of separate exhibition venue and company premises rate.

(g) The Company

For the purpose of this Appendix, the company shall be National Exhibitions Adelaide Pty. Ltd.

(h) The Award

For the purpose of this Appendix, the award shall mean the Carpenters and Joiners (General) Award.

(i) Employee

For the purpose of this Appendix an employee shall mean a person employed as an Exhibition Worker Grade I, II or III as defined and in the employ of National Exhibitions Adelaide Pty. Ltd.

(j) Ordinary Time

For the purpose of this Appendix ordinary time shall mean work performed between the hours of 7.00 a.m. to 6.00 p.m. Monday to Friday.

3 WAGES SCHEDULE

(i) The wage rates prescribed in this Appendix are exclusive of the tool allowance as prescribed in the award as the company provides all tools to employees for the purpose of the carriage of their employment.

The following rates shall apply to the defined employees of National Exhibitions Adelaide Pty. Ltd. for work performed in ordinary time.

(iv) Special Rates as prescribed in Clause 5 of this appendix shall apply to both full time and casual employees.

(v) Additional rates as prescribed in clauses 6 and 7 of this appendix shall apply depending upon whether the employee is full time or casual.

The wage rate of Exhibition Worker Grade I is based on the carpenter engaged in shopfitting classification of the award. The rate excludes the tool allowance and is calculated as follows:

It is agreed that 60% of all time worked is on a venue loading should represent 60% of the full on venue rate. Therefore the on venue loading:

5 SPECIAL RATES

(i) In addition to the rates prescribed in this appendix, the special rates prescribed in clause 15 of this award shall apply.

6 FULL TIME EMPLOYEES

(i) Full time employees of National Exhibitions Adelaide Pty. Ltd. as defined in this appendix shall be deemed to be hired by the week. For the purpose of this appendix, subclauses 27 (2) (i) and 27 (2) (ii) of the award shall apply.

(ii) The ordinary working hours for a full time employee of the Company shall be worked as a 19 day four week cycle of eight hours each on Monday to Friday inclusive between the hours of 7.00 a.m. and 6.00 p.m. with 0.4 of one hour of each day worked accruing as an entitlement to take one day in each 20 day cycle as a day off for as though worked and may be taken at a time as mutually agreed between the employee and the company provided that all such days in any one calendar year (1 January to 31 December) are taken in that calendar year.

(iii) Hours worked by full time employees outside the hours of 7.00 a.m. to 6.00 p.m. Monday to Friday, or on weekends or public holidays shall be paid at overtime penalties as prescribed in the award.

7 CASUAL EMPLOYEES

(a) General

(i) A casual employee is one engaged on hourly hire and shall be paid accordingly.

(ii) There shall be no restriction in this appendix with regard to the minimum and maximum hours worked by casual employees subject to mutually agreed meal breaks and rest breaks.

(iii) Casual employees shall be paid for work performed in ordinary time at a rate higher by twenty per centum than the ordinary hourly rate (computed as 1/38th of the weekly rate prescribed in clause 3 (ii) of this appendix).

(iv) Casual Employees shall not be entitled to sick leave, annual leave or annual leave loading, allowance for which has been made in the loading prescribed in (iii) above.

(b) Penalty rates and Loadings

(i) All time worked Monday to Friday outside the hours of 7.00 a.m. to 6.00 p.m. shall incur a loading of twenty per centum in addition to the loading prescribed in clause 6(a)(iii) of this appendix (i.e. a total loading of forty per centum).

(ii) All time worked on Saturdays, Sundays and Public Holidays between the hours of 7.00 a.m. and 6.00 p.m. shall mean a loading of twenty per centum in addition to the loading prescribed in clause 6(a) (iii) of this appendix (i.e. a total loading of forty per centum).

(iii) All time worked on Saturdays, Sundays and Public Holidays outside the hours of 7.00 a.m. to 6.00 p.m. shall incur a loading of sixty per centum in lieu of the twenty per centum prescribed in clause 6(a) (iii) of this appendix.

8 TOOLS

(i) All tools shall be supplied to employees by the company on the condition that a tool allowance will not be embodied in the rates prescribed in clause 3 of this appendix.

(ii) Employees shall abide by the company policy in relation to procedures regarding the requisitions, use and return of company tools.

9 SUPERANNUATION

(i) All full time employees of the company are entitled to 3% occupational superannuation.

(ii) Superannuation with respect to casual employees shall be further discussed by the parties.

10 NO EXTRA CLAIMS

It is a term of this appendix (arising from the decision of the South Australian Industrial Commission in the State Wage Case of 12 July, 1991, the terms of which are set out in print I.59 of 1991) that the union(s) undertake(s), until 1 November, 1991, not to pursue any extra claim, award or overaward, except when consistent with those principles.

11 LEAVE RESERVED

It is accepted by the parties to this appendix that changes may occur to the Carpenters and Joiners (General) Award as a result of negotiations in that Award and the Carpenters and Joiners Award 1967 (Federal) pursuant to the current Wage Fixation Principles as set out in Print H9100 of the Australian Industrial Commission and Print I.69/89 of the South Australian Industrial Relations Commission.

In the event that such changes occur leave is reserved to the parties to make application to the South Australian Industrial Commission to reconsider the terms and conditions of this appendix and the appropriate method of industrial regulation.

12 DATE OF OPERATION

This appendix shall take effect on and from 1st June, 1990 and shall remain in operation for a period of three calendar months.
