AP785611 - Journalists (Television) Award 1998
5.1 Subject to subclause 5.2, this award shall be binding upon the employers named in schedules 1 and 2 hereto and upon the Media, Entertainment and Arts Alliance and its officers and members in the Commonwealth of Australia in respect of all work done by members of the Alliance for the said employers (hereinafter called "employers") in the various engagements in the industry of journalism in television news services and current affairs programs in the classifications hereinafter appearing.
5.2 Exemptions
5.2.1 News editors - schedule 1 respondents
This award shall not apply to news editors on television stations employed by any respondent named in schedule 1 to this award.
5.2.2 Limited exemption for fixed term contracts of employment - schedule 1 respondents
The provisions of this award which are listed in paragraph 5.2.4 shall not apply to any member employed by a respondent named in schedule 1 to this award where:
5.2.2(a) the member is employed by the respondent after the date of operation of this award under a contract of employment which includes the terms contained in schedule 3 or;
5.2.2(b) in the case of a member who is in employment with a respondent at the date of operation of this award, the member, after that date, enters into a new or varied contract of employment with the respondent which includes the terms contained in schedule 3 and;

5.2.2(c) the member is paid an annual salary not less than $72,216 in lieu.
5.2.3 Limited exemption for fixed term contracts of employment - schedule 2 respondents
The provisions of this award which are listed in paragraph 5.2.4 shall not apply to any member employed by a respondent named in schedule 2 to this award where:
5.2.3(a) the member is employed by the respondent after the date of operation of this award under a contract of employment which includes the terms contained in schedule 3 or;
5.2.3(b) in the case of a member who is in employment with a respondent at the date of operation of this award, the member, after that date, enters into a new or varied contract of employment with the respondent which includes the terms contained in schedule 3 and;

5.2.3(c) the member is paid an annual salary not less than $58,007 in lieu.
