26. TRANSFERS

26.1 The provisions of this clause shall apply to members who are required by their employer to permanently perform their duties in a different town or city to the one in which they were last directed by their employer to perform their duties.

26.2 A member shall not be downgraded as a consequence of any transfer.

26.3 An employer shall reimburse the following costs associated with the transfer:

26.3.1 First class train fare or economy class air fares for the member and his or her family, or if the member travels by car he or she will be paid a mileage allowance.

26.3.2 The transfer and storage of the member's furniture and effects. The member shall obtain at least two quotations for such transfer and storage and the employer shall be obliged to reimburse the lower amount.

26.3.3 Reasonable accommodation costs for a maximum of four weeks or until permanent accommodation is obtained, whichever is the sooner.

26.3.4 Reconnection and installation costs of telephone and other utilities at the member's first new place of residence.

26.5 This subclause does not apply when a member who is transferred under this clause agrees in writing, at the time of the transfer or subsequently, that the city or town to which he or she is transferred will be or has become his or her permanent place of residence.

If the employment of a member is terminated by the employer for a reason other than misconduct, and the member determines to relocate to the city or town in which he or she was located prior to the transfer, the employer shall reimburse to the member the costs which are associated with that relocation referred to in paragraphs 26.3.1 and 26.3.2.

26.6 A member who resigns or is dismissed for misconduct while employed in another town, city or State shall not be entitled to the return fare nor to that of his or her family, nor to any other return expenses.

26.7 The town or city to which a member is transferred shall thereafter be regarded as the town or city in which the member is regularly employed for all purposes of the award.
