PART 6 - HOURS OF WORK, SHIFT WORK, MEAL BREAKS AND OVERTIME 

24. HOURS OF WORK

24.1 The ordinary hours of work of day workers shall be an average of 38 per week to be worked between the hours of 6.00 a.m. and 6.00 p.m. on any or all of the days, Monday to Friday inclusive. Such average 38 hours per week shall be worked on one of the following bases:

24.1.1 38 hours within a work cycle not exceeding seven consecutive days; or

24.1.2 76 hours within a work cycle not exceeding fourteen consecutive days; or

24.1.3 114 hours within a work cycle not exceeding 21 consecutive days; or

24.1.4 152 hours within a work cycle not exceeding 28 consecutive days.

24.1.5 The ordinary hours of work shall not exceed eight hours on any day.

24.2 The spread of hours or the daily hours prescribed may be altered as to all or a section of the employees by mutual agreement between an employer and the majority of employees concerned or in appropriate circumstances, between the employer and an individual employee.

24.2.1 The agreement must be recorded in the time and wages record kept by the employer in accordance with Division 1 of Part 9A of the Workplace Relations Regulations.

24.2.2 If an employee is a member of a union bound by this award, the employee may be represented by the union in meeting and conferring with the employer about the implementation of these extended hours.

24.2.3 The union must be given a reasonable opportunity to participate in negotiations regarding the proposed implementation of a facilitative provision. Union involvement does not mean that the consent of the union is required prior to the introduction of agreed facilitative arrangements.

24.3 There shall be a meal break of not less than 30 minutes nor more than one hour between the hours of 11.00 a.m. and 1.30 p.m.
