26. ARRANGEMENT OF ORDINARY HOURS

26.1 Ordinary hours of work shall be an average of 38 per week as provided in clause 24 - Hours of work, and clause 27 - Shiftwork.

26.2 The ordinary hours of work may be worked in accordance with the following:

26.2.1 by employees working less than eight ordinary hours each day; or

26.2.2 by employees working less than eight ordinary hours on one or more days each week; or

26.2.3 by fixing one week day on which all employees will be off during a particular work cycle; or

26.2.4 by rostering employees off on various days of the week during a particular work cycle so that each employee has one week day off during that cycle; or

26.2.5 by any agreed variation to the above methods.

26.3 In each plant, an assessment should be made as to which method of application best suits the business and the proposal shall be discussed with the majority of employees concerned. This does not preclude agreement being reached with individual employees.

26.4 Notice of days off

An employee is entitled to a day off during his/her work cycle, such employee shall be advised by the employer at least seven days in advance of the week day he/she is to take off unless otherwise agreed.

26.5 Substitute days

26.5.1 An employer, with the agreement of the majority of employees concerned, may substitute the day an employee is to take off in accordance with this award, for another day in the case of a breakdown in machinery or a failure or shortage of electric power or to meet the requirements of the business in the event of rush orders or some other emergency situation.

26.5.2 An individual employee, with the agreement of his/her employer may substitute the day he/she is to take off for another day.

26.5.3 Where application of the 38 hour week is agreed to in accordance with 26.2.3 or 26.2.4, an employee and his/her employer may agree to a banking system of rostered days off provided that not more than three days can be banked for any employee in any one period.

26.5.4 An employee would therefore work on what would normally have been his or her rostered day off and accrue an entitlement to bank a rostered day off to be taken at a mutually convenient time for both the employee and the employer, provided that no less than seven days' notice is given before taking the banked rostered day(s) off.

26.5.5 No payments or penalty payment shall be made to employees working under this substitute banked rostered day off. However the employer will maintain a record of the number of rostered days banked and will apply the average pay system during the weeks when an employee elects to take a banked rostered day off.

26.5.6 Employees terminating prior to taking any banked rostered day(s) off shall receive the following:
