Modern Awards Review 2012—application to vary the Commercial Sales Award 2010.
A. Further to the decision issued on 17 October 2012 1 it is ordered that the Commercial Sales Award 20102 be varied as follows:
1. By deleting clause 23.1 and inserting the following:
23.1 Overtime
An employee directed by the employer to perform any work after 6.00pm Monday to Friday inclusive, or in excess of the ordinary hours of work provided in clause 21 – Ordinary hours of work and rostering will be paid at a rate of time and a half of the applicable rate set out in clause 13.1.
2. By deleting clause 23.2 and inserting the following:
23.2 Saturday work
An employee directed by the employer to perform any work on a Saturday will be paid at a rate of time and a half of the applicable rate set out in clause 13.1, with a minimum payment of two hours.
3. By deleting clause 23.3 and inserting the following:
23.3 Sunday work
An employee directed by the employer to perform any work on a Sunday will be paid at a rate of double time of the applicable rate set out in clause 13.1, with a minimum payment of three hours.
B. This determination comes into operation on the first full pay period on or after 29 October 2012.
