Application for an FWC order to stop bullying.
Further to my reasons in [2015] FWC 6556 and further to my reasons in [2015] FWC 7244 and pursuant to s.789FF of the Fair Work Act 2009, the Fair Work Commission orders that:
A. The Directors of View Launceston Pty Ltd (trading as View Launceston (ABN 99 727 630 619)) shall:
[1] appoint Mr Allan Hart as the ‘transition to work’ contact for Ms Roberts with the understanding Mr Hart is to oversee Ms Roberts return to the workplace and to be available as a contact person for Ms Roberts;
[2] within 28 days of this Order, prepare and implement a stand-alone workplace anti-bullying policy which contains a detailed complaints procedure to be followed in the event an employee believes they are being bullied and wishes to make a complaint;
[3] within two months of this Order, conduct training for all employees of View Launceston Pty Ltd (trading as View Launceston) on the stand-alone workplace anti-bullying policy and complaints procedure;
[4] within two months of this Order, conduct training for all employees of View Launceston Pty Ltd (trading as View Launceston) on appropriate standards of behaviour in the workplace, and I recommend such training be conducted by the Anti-Discrimination Commission in Tasmania.
B. Mrs Lisa Bird, from the date of this Order, shall:
[1] not belittle or humiliate Ms Roberts at work;
[2] not deliberately or unreasonably delay the performance of administration work for Ms Roberts;
[3] not speak to, or act towards, Ms Roberts in an aggressive or abrupt way at work;
[4] not denigrate Ms Roberts to any of Ms Roberts’ clients, any other View Launceston clients, or to other employees of View Launceston; and
[5] acknowledge Ms Roberts each morning at the workplace and behave toward Ms Roberts in a reasonable and professional manner.
