Appeal pursuant to OPGGS.

[1] The Fair Work Commission (Commission) orders by consent that:

• this proceeding be dismissed as against the National Offshore Petroleum Safety and Environmental Management Authority T/A NOPSEMA (Respondent); and



• there be no order as to costs.

[2] The Commission notes the undertaking of the Respondent not to publish or otherwise refer to Improvement Notice number 0539 (IN0539) to members of the general public in any medium under its control, save to permit publication by the Respondent of the following text on its website:

“Proceedings numbered C2014/3066 in the Fair Work Commission commenced by Sedco Forex International Inc against NOPSEMA has been dismissed by the parties’ consent. IN0539 has been complied with and there are no outstanding issues relating to this matter.”
