Penalty rates – public holiday penalty rates – Sunday penalty rates.

A. Further to the decisions issued by the Fair Work Commission, 1 the above award is varied as follows:

1. By deleting the words “the Sunday rate of” appearing in clause 26.2(a)(i) and inserting “the rate of”.

2. By deleting the words “the public holiday rate of” appearing in clause 26.2(a)(i) and inserting “the rate of”.

3. By deleting clause 26.2(d) and inserting the following:

(d) Sunday work – 7.00 am to 9.00 pm

A 95% (casuals 120%) loading will apply for all ordinary hours worked on a Sunday between 7.00 am and 9.00 pm.

An 80% (casuals 105%) loading will apply for all ordinary hours worked on a Sunday between 7.00 am and 9.00 pm.

A 65% (casuals 90%) loading will apply for all ordinary hours worked on a Sunday between 7.00 am and 9.00 pm.

A 50% (casuals 75%) loading will apply for all ordinary hours worked on a Sunday between 7.00 am and 9.00 pm.

4. By inserting a new clause 26.2(e) as follows:

(e) Sunday work – before 7.00 am and after 9.00 pm

5. By deleting clause 31.3 and inserting the following:

31.3 Work on a public holiday must be compensated by payment at the rate of 225% (casuals 250%) of the minimum rate.

B. This determination comes into operation from 1 July 2017. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect until the start of the first full pay period that starts on or after 1 July 2017.
