4 yearly review of modern awards – Casual employment and Part-time employment – minimum engagement for part-time employees and casual employees – Manufacturing and Associated Industries and Occupations Award 2010.

A. Further to the Full Bench decision issued by the Fair Work Commission on 9 August 2018 [[2018] FWCFB 46951, the above award is varied as follows:

1. By deleting clause 13.2 and inserting the following:

13.2 A part-time employee must be engaged and paid for a minimum of 4 consecutive hours per day or shift. In order to meet their personal circumstances, a part-time employee may request and the employer may agree to an engagement for no less than 3 consecutive hours per day or shift. The agreement reached must be recorded by the employer on the employee’s time and wages record.

2. By deleting clause 14.2 and inserting the following:

14.2 On each occasion a casual employee is required to attend work the employee must be paid for a minimum of four consecutive hours’ work. In order to meet their personal circumstances a casual employee may request and the employer may agree to an engagement of no less than three consecutive hours.

3. By updating the table of contents and cross-references accordingly.

B. This determination comes into operation from 1 October 2018. In accordance with s.165(3) of the Fair Work Act 2009 these items do not take effect until the start of the first full pay period on or after 1 October 2018.
