Application for an unfair dismissal remedy – not a small business employer – alleged serious misconduct – misconduct not substantiated – no valid reason – dismissal was unfair – compensation ordered.

A. Further to my decision 1 in the above matter, I order that the respondent, Advanced Health Invest Pty Ltd T/A Mastery Dental Clinic, pay the applicant, Mei Kuen Chan, compensation in the amount of $40,000.00, less applicable taxation.

B. I also order the respondent to pay the applicant the applicable superannuation on the amount in item A above.

C. The above amounts are to be paid within 14 days of the date of this order.
