4 yearly review of modern awards - Real Estate Industry Award 2010 - substantive issues - variations to clause 16 - correction.

A. The determination issued by the Full Bench on 1 May 2019 [PR707387] is corrected as follows:

1. By renumbering items A.1 to A.7 as A.2 to A.8.

2. By inserting a new item A.1 as follows:

“1. By deleting clause 10.3(b)(ii) and inserting the following:

(ii) Part-time employees will be paid no less than 1/38th of the minimum weekly rate of pay for their relevant classification for each ordinary hour worked.”

3. By deleting items B and C and inserting the following:

“B. Items 3, 5, 6, and 8 of this determination come into operation from 30 April 2019. In accordance with s.165(3) of the Fair Work Act 2009 these items do not take effect until the start of the first full pay period that starts on or after 30 April 2019.

C. Items 2, 4 and 7 of this determination come into operation from 30 June 2019. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect until the start of the first full pay period that starts on or after 30 June 2019.”

B. This determination comes into operation from 3 July 2019. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect until the start of the first full pay period that starts on or after 3 July 2019.
