Re-instatement order.

A. Further to the decision [2020] FWC 5486 issued on 14 October 2020 and pursuant to s 391 of the Fair Work Act 2009, the Fair Work Commission orders that:

1. Centennial Myuna Pty Ltd reinstate Mr Geoffrey Dyson to the position in which he was employed immediately before his dismissal, namely Undermanager.

2. Centennial Myuna Pty Ltd maintain continuity of service for Mr Geoffrey Dyson from the date of termination of his employment to the date of reinstatement.

3. Centennial Myuna Pty Ltd pay to Mr Geoffrey Dyson an amount for the remuneration lost by him because of his dismissal, but only in respect of the period from 21 July 2020 to the date of his reinstatement.

B. This order is to be complied with within 14 days of the date of this order.

C. Each party has liberty to apply in the event that there is a dispute about the calculation of the amount to be paid to Mr Geoffrey Dyson pursuant to A.3 above.
