4 yearly review of modern awards – Supported Employment Services Award 2020 – Superannuation for employees with disabilities.

A. Further to the Full Bench decision issued by the Fair Work Commission on 2 October 2020 [[2020] FWCFB 5295], the above award is varied as follows:

1. By deleting clause 20.5 and inserting the following:

20.5 Employees with disabilities

Superannuation contributions for employees with a disability will be either 9.5% of their ordinary time earnings or $15 per week, whichever is the greater.

B. This determination comes into operation from 1 January 2021. In accordance with s.165(3) of the Fair Work Act 2009, this determination does not take effect in relation to a particular employee until the start of the employee’s first full pay period that starts on or after 1 January 2021.
