Stay order

Pursuant to s 606(1) of the Fair Work Act 2009, and further to the interim stay order issued on 18 November 2020 (PR724668), the Commission orders by consent:

1. The underlined part of paragraph [1]a) of the Order of Commissioner Wilson dated 4 November 2020 (PR724193) as set out in the Schedule is stayed pending the determination of the appeal in matter C2020/8357 or until further order of the Commission.

2. This order will take effect from 24 November 2020.

SCHEDULE

a) Pursuant to s 391(1) of the Fair Work Act 2009 (the Act) the Respondent, Chelgrave Contracting Australia Pty Ltd, shall reinstate the Applicant, Mr Chaya Johnson, to his former position as C7 Maintenance Fitter at the Carlton United Breweries Abbotsford site.
