Application for a single interest employer authorisation.

[1] Pursuant to s.249 of the Fair Work Act 2009 (the Act), the Fair Work Commission makes a single interest employer authorisation to cover the following employers in relation to the bargaining process for the proposed enterprise agreement:

  Catholic Education Western Australia Limited (ABN 47 634 504 135)

  John XXIII College Inc (ABN 65 415 939 827)

  Loreto Nedlands Limited (ABN 42 317 652 643)

  Mazenod College Limited (ABN 53 128 213 267)

  Mercy Education Limited (ACN 154 531 870)

  Norbertine Canons Inc (ABN 29 781 711 208)

  Servite College Council Inc (ABN 69 356 899 381)

  Trustees of Edmund Rice Education Australia (ABN 96 372 268 340)

  Trustees of the Marist Brothers (Marist Schools Australia) (ABN 91 064 875 510)

[2] The employees to be covered by the proposed enterprise agreement are all teaching staff registered with the Teacher Registration Board of Western Australia, employed by the employers listed at [1] above, working in:

a. A school registered pursuant to the School Education Act 1999 (WA); and/or

b. A long day care, occasional care (including those occasional care services not licensed), childcare centres, daycare facilities, out-of-school hours care, kindergartens and preschools, and early childhood intervention programs.

So as to remove any doubt, teaching staff includes a teacher in a senior leadership position, but not a principal, or assistant principal, or deputy principal, or similar position however so named.

[3] The person nominated by the employers named at [1] above is Dr Debra Sayce, Executive Director of CEWA Ltd to make applications pursuant to the Act if this single interest authorisation is granted.

[4] The authorisation comes into operation from the date of this order.
