4 yearly review of modern awards – common issue – overtime for casuals – Labour Market Assistance Industry Award 2020.

A. Further to the decision issued by the Fair Work Commission on 17 May 2022 [[2022] FWC 1202], the above award is varied as follows:

1. By deleting clause 21.2(c) and inserting the following:

(c) Public holidays

An employee who, with the approval of the employer, works on a public holiday will be paid 250% of the minimum hourly rate for all hours worked.

2. By deleting clause 21.3(c) and inserting the following:

(c) Public holidays

An employee who, with the approval of the employer, works on a public holiday will be paid 312.5% of the minimum hourly rate for all hours worked.

3. By deleting the note appearing at the end of clause 21.3 and inserting the following:

NOTE: The overtime rates for casual employees have been calculated by adding the casual loading prescribed by clause 11.3(b) to the minimum hourly rate before applying the overtime rates for full-time and part-time employees prescribed by clause 21.2.

4. By deleting clause 29.2 and inserting the following:

29.2 Payment for working on a public holiday

(a) For full-time and part-time employees, payment for working on a public holiday is provided for in clause 21.2(c).

(b) For casual employees, payment for working on a public holiday is provided for in clause 21.3(c).

5. By deleting clause B.1.2 and inserting the following:

1 Late work means work performed between 8.00 pm and midnight Monday to Friday inclusive.

2 Early work means work performed between the hours of midnight and 6.00 am from Sunday to Friday inclusive.

3 A sessional employee will be at Employment services officer grade 1 Pay point 3.

B. This determination comes into operation on 23 May 2022. In accordance with s.165(3) of the Fair Work Act 2009, this determination does not take effect in relation to a particular employee until the start of the employee’s first full pay period that starts on or after 23 May 2022.
