Variation on the Commission’s own motion – changes to the Superannuation Guarantee (Administration) Act 1992 – ambiguity or uncertainty.

A. Further to the statement issued by the Fair Work Commission on 2 May 2022 [[2022] FWC 992] and the decision issued on 1 June 2022 [[2022] FWC 1379], the above award is varied as follows:

1. By deleting clause 22.2(b) and renumbering clause 22.2(a) as clause 22.2.

2. By updating the cross-references accordingly.

B. This determination comes into operation on 1 July 2022. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect in relation to a particular employee until the start of the employee’s first full pay period that starts on or after 1 July 2022.
