Section 160 of the Fair Work Act 2009 (Cth) – variation on the Commission’s own motion – residual variations – Manufacturing and Associated Industries and Occupations Award 2020.

A. Further to the decisions issued by the Full Bench on 8 July 2022 [[2022] FWCFB 119] and on 28 July 2022 [[2022] FWCFB 138], the above award is varied as follows:

1. By deleting the year “2010” appearing in clause 2 and inserting “2020”.

2. By deleting the year “2010” appearing in clause 4.10(i) and inserting “2020”.

3. By deleting clause 34.1 and inserting the following:

34.1 Annual leave is provided for in the NES. Except as provided for in clause 48, annual leave does not apply to a casual employee.

4. By deleting the year “2010” appearing in clause A.3.1 and inserting “2020”.

5. By deleting the words “An Vehicle” appearing in clause B.6.1(b) and inserting “A Vehicle”.

6. By inserting the words “or G.4.4” after the words “clause G.4.2” appearing in clause G.4.3(a).

B. This determination comes into operation on 1 August 2022. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect in relation to a particular employee until the start of the employee’s first full pay period that starts on or after 1 August 2022.
