Application to vary the Victorian Local Government Award 2015 (state-reference public sector award) – minimum engagement for certain casual employees contested – award varied.

A. Further to the decision issued by the Full Bench on 31 October 2022 ([2022] FWCFB 197), the above award is varied as follows:

1. By renumbering clause 10.5(c) as clause 10.5(d).

2. By inserting a new clause 10.5(c) as follows:

(c) Minimum engagement

3. By updating the cross references accordingly.

B. This determination comes into operation on 1 February 2023. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect in relation to a particular employee until the start of the employee’s first full pay period that starts on or after 1 February 2023.
