3. ANTI-DISCRIMINATION
3.1 It is the intention of the respondents to this award to achieve the principal object in s.3(j) of the Workplace Relations Act 1996 by helping to prevent and eliminate discrimination on the basis of race, colour, sex, sexual preference, age, physical or mental disability, marital status, family responsibilities, pregnancy, religion, political opinion, national extraction or social origin.
3.2 Accordingly, in fulfilling their obligations under the disputes avoidance and settling clause, the respondents must make every endeavour to ensure that neither the award provisions nor their operation are directly or indirectly discriminatory in their effects.
3.3 Nothing in this clause is to be taken to affect:
3.3.1 any different treatment (or treatment having different effects) which is specifically exempted under the Commonwealth anti-discrimination legislation;
3.3.2 junior rates of pay;
3.3.3 an employee, employer or registered organisation, pursuing matters of discrimination in any State or federal jurisdiction, including by application to the Human Rights and Equal Opportunity Commission;
3.3.4 the exemptions in s.170CK(3) and (4) of the Act.
4. COMMENCEMENT DATE OF AWARD AND PERIOD OF OPERATION
This award shall come into operation from the beginning of the first pay period commencing on or after 18 December, 2001 and shall remain in force for a period of twelve months.
5. COVERAGE OF AWARD
This award applies to the distribution of petrol and/or petroleum products in the Australian Capital Territory and in all states of the Commonwealth (except where the Transport Workers' (Northern Territory Oil Agents/Contractors) Award 1990 [Print J2767 [AW799333]] applies.
6. PARTIES BOUND
6.1 This award is binding upon:
6.1.1 The Transport Workers' Union of Australia, its officers and its members; and
6.1.2 the employers named in schedule A of this award in respect of all their employees whether members of the union or not engaged on any of the classes of work set out in the classifications and/or grade structures in this award.
6.2 This award shall not be binding on an employer or employee who is bound by the terms and conditions of the Vehicle Industry - Repair, Services and Retail - Award 1983 [Print H5658 [AW801827CRA]], where such employee is not engaged predominantly in the distribution (other than direct from fixed petrol pumps to motor vehicle fuel tanks) of petroleum products.
7. RELATIONSHIP WITH OTHER AWARDS
This award supersedes the Transport Workers (Oil Agents/Contractors) Award 1981 [AW799334] but no right, obligation or liability accrued or incurred under that award as varied shall be hereby affected.
8. DEFINITIONS
In this award, unless a contrary intention appears:
8.1 Aerodrome attendant means an employee employed principally in driving and/or operating any aviation refuelling or servicing unit or equipment or hydrant dispensing system at an aerodrome to deliver aviation fuels, lubricants and/or other aviation products to aircraft and in receiving, storing and distributing such fuels, lubricants and other products at an aerodrome depot, including the performance as required of all tasks ancillary to such receipt, storage, distribution and delivery. Provided that this definition shall not be construed to exclude allotment by the employer of other duties connected with the safe and efficient operation of vehicles, units, plant and equipment, and the general tidiness of facilities at an airport depot, and the safety of personnel, or the bridging of stocks from terminals or depots to airports by an aerodrome attendant.
This definition does not include coxswains or motorboat drivers operating refuelling units at a flying-boat base.
8.2 Senior aerodrome attendant means a senior aerodrome attendant appointed as such by the employer, but not less than one per shift.
8.3 Articulated vehicle means a vehicle with three or more axles comprising a power unit (called tractor-truck or prime mover) and semi-trailer which is superimposed on the power unit revolving on a turntable and is an articulated vehicle whether automatically detachable or permanently coupled.
8.4 Bituminous-products-sprayperson means an employee working under the direction of the driver of a bitumen spraying vehicle; and, without limiting the scope of the duties, the said duties shall include operations of the spraying equipment at the rear end of the vehicle, operation of the lance-type hand-spray, moving the vehicle during hand-spraying operations, and assisting the driver in the driving of the vehicle.
8.5 Dual steer vehicle means either a rigid vehicle which has more than one steering axle or an articulated vehicle with more than one steering axle on the prime mover.
8.6 Lazy-axle rigid delivery vehicle means a vehicle of similar construction to a tandem-drive rigid delivery vehicle with the difference that only one of the rear axles has a differential through which the driving power is transmitted and excludes an articulated vehicle.
8.7 Driver means any employee engaged to drive or control any type of delivery vehicle specified in this award irrespective of the employee's other duties. This definition shall not exclude other duties ordinarily performed by a driver including the loading and unloading of bulk vehicles.
8.8 Tandem-drive rigid delivery vehicle means a long-wheel-base single-unit vehicle (in which the engine, driving compartment and load-carrying compartment, tank or tray are all mounted on the one chassis) having two rear axles each with its own differential through which the driving power is transmitted to the rear wheels and excludes an articulated vehicle.
8.9 Union means the Transport Workers' Union of Australia.
8.10 Western District of Queensland means all that part of the State of Queensland south-west of the boundary commencing at the State border at parallel 22 degrees 30 minutes of south latitude thence east by that parallel of latitude to 147 degrees of longitude thence by that meridian of longitude due south to the twenty-fifth degree of south latitude thence due east by that parallel of latitude to 150 degrees of longitude then due south by that meridian of longitude to the border of the State.
8.11 Ordinary-time rate means for an employee (other than a casual employee) 1/35th of the wage rate prescribed in clause 16 - Classifications and wage rates, of this award for the classification in which the employee is employed.
8.12 Time and a half means one and a half times the ordinary-time rate.
8.13 Double time means twice the ordinary-time rate.
8.14 Double time and a half means two and a half times the ordinary time rate.
8.15 Triple time means three times the ordinary-time rate.
8.16 APADA means the Australian Petroleum Agents and Distributors Association.
8.17 Rural distribution operations means:
8.17.1 an establishment located further than a radius of 75 kilometres from a capital city and/or oil company terminal/refinery;
8.17.2 an establishment located within a radius of 75 kilometres from a capital city and/or oil company terminal/refinery, and in respect of which application that the establishment be deemed to be a rural distribution operation has been made to the State Secretary of the union and in respect of which the union has so agreed. The union shall not unreasonably withhold its consent and any dispute shall be dealt with in accordance with the dispute settling procedure provided by this award.
8.18 Union delegate shall mean an employee appointed as union delegate (or an employee appointed as co-delegate to act in the absence of the delegate) in a yard or depot who shall upon notification thereof to the employer by the branch or sub-branch Secretary of the union, be recognised as the accredited representative of the union and shall be allowed the necessary time during working hours to interview the employer or its representative on matters affecting employees in the yard or depot.
PART 2 - AWARD FLEXIBILITY
9. ENTERPRISE FLEXIBILITY
(See ss.113A and 113B of the Act)
Where an employer or employees wish to pursue an agreement at the enterprise or workplace about how the award should be varied so as to make the enterprise or workplace operate more efficiently according to its particular needs, the following process shall apply:
9.1 A Consultative mechanism and procedures appropriate to the size, structure and needs of the enterprise or workplace shall be established.
9.2 For the purpose of the consultative process the employees may nominate the union bound by this award or another employee representative to represent them.
9.3 Where agreement is reached an application shall be made to the Australian Industrial Relations Commission.
10. FACILITATIVE PROVISIONS
10.1 Agreement to vary award provisions
10.1.1 This award contains facilitative provisions which allow agreement between an employer and employees on how specific award provisions are to apply at the workplace or section or sections of it. The facilitative provisions are identified in 10.2.1 and 10.3.1 hereof.
10.1.2 The specific award provisions establish both the standard award condition and the framework within which agreement can be reached as to how the particular provisions should be applied in practice. Facilitative provisions are not to be used as a device to avoid award obligations nor should they result in unfairness to an employee or employees covered by this award.
10.2 Facilitation by individual agreement
10.2.1 The following facilitative provisions can be utilised upon agreement between the employer and an employee provided that the agreement complies with 10.2.2 hereof:

Clause 22 - Meal break - day workers
10.2.2 The agreement reached must be recorded in the time and wage record kept by the employer in accordance with Division 1 of Part 9A of the Workplace Relations Regulations.
10.2.3 Union representation
10.2.3(a) If an employee is a member of the union, the employee may be represented by the union in meeting and conferring with the employer about the implementation of the facilitative provisions.
10.2.3(b) The union must be given a reasonable opportunity to participate in negotiations regarding the proposed implementation of a facilitative provision. Union involvement does not mean that the consent of the union is required prior to the introduction of agreed facilitative arrangements.
10.3 Facilitation by majority agreement
10.3.1 The following facilitative provisions may only be utilised upon agreement between the employer and the majority of employees in the workplace or a section or sections of it.

10.3.2 Where agreement has been reached with the majority of employees in the workplace, or a section or sections of it, to implement a facilitative provision in 10.3.1 hereof, that agreement shall be binding on all such employees, provided that the requirements of 10.2.2, 10.2.3 and where specified 10.4 hereof have been met.
10.4 Additional safeguard
10.4.1 An additional safeguard applies to:
Clause 21.1.2 - Hours of work-day workers
Clause 21.2 - Starting and finishing times
Clause 25.4.1 - Seven-day non-continuous shift work
Clause 25.18 - Variations of rosters
10.4.2 The additional safeguard requires that the unions which are party to the award and which have members employed at an enterprise covered by the award shall be informed by the employer of the intention to use all facilitative provisions and shall be given a reasonable opportunity to participate in the negotiations regarding its use. Union involvement in this process does not mean that the consent of the union is required prior to the introduction of agreed facilitative arrangements at the enterprise.
10.5 Majority vote at the initiation of the employer
A vote of employees in the workplace, or a section or sections of it, taken in accordance with 10.3 hereof to determine if there is a majority employee support for implementation of a facilitative provision, will be of no effect, unless taken with the agreement of the employer.
10.6 Dispute over facilitation
In the event that a dispute or difficulty arises over the implementation or continued operation of a facilitative provision, the matter will be handled in accordance with the dispute resolution procedure in clause 11 - Settlement of disputes or claims, of this award.
PART 3 - COMMUNICATION, CONSULTATION AND DISPUTE RESOLUTION
11. SETTLEMENT OF DISPUTES OR CLAIMS
In the event of a dispute or claim arising in the workplace, the procedure to be followed to resolve the dispute will be as follows:
11.1 The matter shall first be discussed between the employee and the employee's supervisor.
11.2 The matter, if not settled, then shall be discussed between the union delegate or other employee representative and the industrial officer or other appropriate officer of the employer concerned. A union delegate, or in a delegate's absence the co-delegate, may interview a member or members of the union who are shift workers during their working hours, provided that as a result of such interview the employer is not required to pay overtime to such delegate, co-delegate or to the employees concerned.
11.3 If not settled, the matter shall be further discussed between the State Secretary of the union or other employee representative and the appropriate representative of the employer.
11.4 If agreement has not been reached, the matter shall then be discussed between a representative of the Head Office of the employer concerned and the appropriate Federal Official of the union or other employee representative. The provisions of this step need not apply when only one company is involved unless either party requests otherwise.
11.5 If the matter is still not settled it shall be submitted to a member of the Australian Industrial Relations Commission whose decision shall, subject to any appeal in accordance with the Act, be final and shall be accepted by the parties. Where the employer is satisfied that a delegate's attendance at an Australian Industrial Relations Commission hearing will contribute to the proper conduct of proceedings involving the employer and the delegate's union, the delegate will be granted the necessary leave without loss of ordinary pay.
11.6 Until the matter is determined and unless an employee has a reasonable concern about an imminent risk to health and safety, work shall continue normally where it is agreed that there is an existing custom but in other cases the work shall continue as instructed by the employer. No party shall be prejudiced as to final settlement by the continuity of work in accordance with this clause.
PART 4 - EMPLOYER AND EMPLOYEES' DUTIES, EMPLOYMENT RELATIONSHIP AND RELATED ARRANGEMENTS
12. EMPLOYMENT RELATIONSHIP
12.1 It is a term and condition of employment and of the obligations and rights accruing under this award that an employee shall:
12.1.1 subject to 24.9 of this award perform such work including shift work as the employer shall, from time to time, reasonably require; and
12.1.2 subject to 24.1.4 of this award comply with the orders of the employer to work reasonable overtime at any time during the seven days of the week at the appropriate remuneration prescribed in this award; and
12.1.3 if the employee is a shift worker who is not relieved as scheduled at the end of the shift, continues to work at the appropriate overtime rate until relieved or otherwise authorised to finish work by the employer; and
12.1.4 use all appropriate protective clothing and equipment provided by the employer for specific circumstances; and
12.1.5 comply with the employer's direction to keep the work place and equipment in a clean and safe condition.
12.1.6 The employer may direct an employee to carry out such duties as are within the limits of the employee's skills, competence and training.
12.1.7 Where an employee is engaged in the transport and distribution of petroleum or petroleum products, the employee shall adhere to the general working standards of the oil industry including the Australian Institute of Petroleum (AIP) Passport with the employer providing all the necessary training, gear and equipment.
12.1.8 On engagement, be placed on a probationary period of three months which shall be taken as service worked for all purposes.
12.1.9 An employee shall not permit any unauthorised person or persons to accompany the employee on the employee's vehicle or permit any such person or persons to assist the employee in the delivery of goods, wares, merchandise or material unless such person or persons have been engaged as an employee or is the owner of such goods, wares or merchandise or material or is the agent of such owner.
12.2 An employee, to become entitled to payment of the weekly wage prescribed by this award, shall be available, ready and willing to perform such work as the employer requires. Any employee so available, ready and willing to work for the whole week and not justifiably dismissed shall be entitled to a full week's wage.
13. EMPLOYMENT CATEGORIES
An employer should definitely state to an employee at the time of engagement whether such engagement is full-time, part-time or casual. Failing such statement, the employee shall be deemed to be engaged on a full-time basis.
13.1 Full-time employment
A full-time employee is a weekly employee other than a part-time employee or a casual employee.
13.2 Casual employment
13.2.1 A casual employee shall be paid per hour at the rate of 1/35th of the appropriate weekly rate plus 20%, with a minimum payment as for one day.
13.2.2 A casual employee who works more than seven hours on any one day, Monday to Friday inclusive, shall be paid at the overtime rate for the time so worked.
13.2.3 A casual employee shall be notified at the end of the day if his or her services are not required for the next working day. Failing the giving of such a notice a full day's wages shall be paid for the next working day.
13.3 Casual employment - rural distribution operations
13.3.1 The employment of a casual employee (rural distribution operations) may be terminated at any time.
13.3.2 A casual employee (rural distribution operations) shall be paid per hour at the rate of 1/35th of the appropriate weekly award rate plus 20%, with a minimum payment as for four hours.
13.3.3 A casual employee who works more than seven hours on any one day, Monday to Friday inclusive, shall be paid at the overtime rate for the time so worked.
13.4 Part-time employment
13.4.1 An employee may be engaged to work on a part-time basis involving a regular pattern of hours which shall average less than 35 hours per week in any one week from Monday to Friday inclusive. Before commencing part-time employment, the employee and the employer must agree:
13.4.1(a) upon the hours to be worked by the employee, the days upon which they will be worked and the commencing and finishing times for the work;
13.4.1(b) upon the classification applying to the work to be performed in accordance with clause 16 - Classifications and wage rates, of this award.
13.4.2 Except as otherwise provided in this award, a part-time employee is entitled to be paid for the hours agreed upon in accordance with 13.4.1(a) hereof.
13.4.3 The terms of this agreement may be varied by consent between the employer and employee.
13.4.4 The terms of this agreement or any variation to it shall be in writing and retained by the employer. A copy of the agreement and any variation to it shall be provided to the employee by the employer.
13.4.5 The terms of this award shall apply prorata to part-time employees on the basis that ordinary weekly hours for full-time employees are 35.
13.4.6 Part-time employees will not be required to work split shifts.
13.4.7 Part-time employees will be engaged for a minimum of four consecutive hours in any day from Monday to Friday inclusive.
13.4.8 A part-time employee who is required to work in excess of the hours agreed upon in accordance with 13.4.1(a) hereof shall be paid overtime in accordance with the relevant overtime provisions in this award.
13.4.9 Where the part-time employee's normal paid hours fall on a holiday prescribed in clause 30 - Public holidays, of this award and work is not performed by the employee, such employee shall not lose pay for the day. Where the employee works on the holiday, such employee shall be paid in accordance with clause 30 of this award.
14. REDUNDANCY
14.1 Definition
Redundancy occurs when an employer decides that the employer no longer wishes the job the employee has been doing to be done by anyone and this is not due to the ordinary and customary turnover of labour.
14.2 Transfer to lower paid duties
Where an employee is transferred to lower paid duties by reason of redundancy the same period of notice must be given as the employee would have been entitled to if the employment had been terminated and the employer may at the employer's option, make payment in lieu thereof of an amount equal to the difference between the former ordinary rate of pay and the new ordinary time rate for the number of weeks of notice still owing.
14.3 Severance pay
14.3.1 In addition to the period of notice prescribed for ordinary termination in clause 15 - Termination of employment, of this award an employee whose employment is terminated by reason of redundancy must be paid, subject to further order of the Commission, the following amount of severance pay in respect of a continuous period of service:

14.3.2 Week's pay means the ordinary time rate of pay for the employees concerned.
14.3.3 Provided that the severance payments shall not exceed the amount which the employee would have earned if employment with the employer had proceeded to the employee's normal retirement date.
14.4 Employee leaving during notice period
An employee whose employment is terminated by reason of redundancy may terminate the employment during the period of notice and, if so, will be entitled to the same benefits and payments under this clause had they remained with the employer until the expiry of such notice. However, in this circumstance the employee will not be entitled to payment in lieu of notice.
14.5 Alternative employment
An employer, in a particular redundancy case, may make application to the Commission to have the general severance pay prescription varied if the employer obtains acceptable alternative employment for an employee.
14.6 Time off during notice period
14.6.1 During the period of notice of termination given by the employer an employee shall be allowed up to one day's time off without loss of pay during each week of notice for the purpose of seeking other employment.
14.6.2 If the employee has been allowed paid leave for more than one day during the notice period for the purpose of seeking other employment, the employee shall, at the request of the employer, be required to produce proof of attendance at an interview or shall not receive payment for the time absent. For this purpose a statutory declaration will be sufficient.
14.7 Superannuation benefits
14.7.1 Subject to further order of the Commission where an employee who is terminated receives a benefit from a superannuation scheme, the employee shall only receive under 14.3 hereof the difference between the severance pay specified in that clause and the amount of the superannuation benefit the employee receives which is attributable to employer contributions only.
14.7.2 If this superannuation benefit is greater than the amount due under 14.3 hereof then the employee shall receive no payment under that clause.
14.8 Employees exempted
14.8.1 This clause shall not apply where employment is terminated as a consequence of conduct that justifies instant dismissal including inefficiency within the first fourteen days, neglect of duty or misconduct, and in the case of casual employees, apprentices or employees engaged for a specific period of time or for a specific task or tasks.
14.8.2 Notwithstanding the foregoing provisions trainees who are engaged for a specific period of time shall, once the traineeship is completed and provided that the trainee services are retained, have all service including the training period counted in determining entitlements. In the event that a trainee is terminated at the end of his or her traineeship and is re-engaged by the same employer within six months of such termination the period of traineeship shall be counted as service in determining any future redundancy entitlements.
14.9 Employers exempted
Subject to an order of the Commission, in a particular redundancy case, this clause shall not apply to employers who employ less than fifteen employees.
14.10 Incapacity to pay
An employer, in a particular redundancy case, may make application to the Commission to have the general severance pay prescription varied on the basis of the employer's incapacity to pay.
15. TERMINATION OF EMPLOYMENT
15.1 Notice of termination by employer
15.1.1 In order to terminate the employment of a full-time or regular part-time employee the employer shall give to the employee the period of notice specified in the table below:

15.1.2 In addition to this notice, employees over 45 years of age at the time of the giving of the notice with not less than two years continuous service, are entitled to an additional week's notice.
15.1.3 Payment in lieu of the notice will be made if the appropriate notice period is not required to be worked. Employment may be terminated by the employee working part of the required period of notice and by the employer making payment for the remainder of the period of notice.
15.1.4 In calculating any payment in lieu of notice, the wages an employee would have received in respect of the ordinary time they would have worked during the period of notice had their employment not been terminated will be used.
15.1.5 The period of notice in this clause, shall not apply in the case of dismissal for conduct that justifies instant dismissal including inefficiency within the first fourteen days, neglect of duty or misconduct and in the case of casual employees, apprentices or employees engaged for a specific period of time or for a specific task or tasks.
15.1.6 Notwithstanding the foregoing provisions trainees who are engaged for a specific period of time shall once the traineeship is completed and provided that the trainees' services are retained have all service including the training period counted in determining entitlements. In the event that a trainee is terminated at the end of his or her traineeship and is re-engaged by the same employer within six months of such termination the period of traineeship shall be counted as service in determining any future termination.
15.2 Notice of termination by an employee
15.2.1 The notice of termination required to be given by an employee is the same as that required of an employer, save and except that there is no requirement on the employee to give additional notice based on the age of the employee concerned.
15.2.2 If an employee fails to give notice the employer has the right to withhold monies due to the employee to a maximum amount equal to the ordinary time rate of pay for the period of notice.
15.3 Time off during notice period
Where an employer has given notice of termination to an employee, an employee shall be allowed up to one day's time off without loss of pay for the purpose of seeking other employment. The time off shall be taken at times that are convenient to the employee after consultation with the employer.

16. CLASSIFICATIONS AND WAGE RATES
The minimum wage to be paid to an adult employee of the classification specified herein shall, except as otherwise required in this award, be at the rate herein after assigned to that classification.

The residual component in the above table represents the total of the component above the minimum rate. Individual employees entitled to a particular pay point at the time this award was made will not be paid less than that pay point. Any future increases in rates in the award will only be applied to the minimum rates component and absorbed against the residual component.
Notwithstanding the minimum rates contained in this clause, an employee's actual wage rates will not be reduced.
16.5 Arbitrated Safety Net Adjustment
16.5.1 The rates of pay in this award include the arbitrated safety net adjustment payable under the Safety Net Review - Wages April 1999 decision [Print R1999] and April 2000 decision [Print S5000]. This arbitrated safety net adjustment may be offset against any equivalent amount in rates of pay received by employees whose wages and conditions of employment are regulated by this award which are above the wage rates prescribed in the award. Such above award payments include wages payable pursuant to certified agreements, currently operating enterprise flexibility agreements, Australian workplace agreements, award variations to give effect to enterprise agreements and over award arrangements. Absorption which is contrary to the terms of an agreement is not required.
16.5.2 Increases made under previous National Wage case principles or under the current Statement of Principles, excepting those resulting from enterprise agreements, are not to be used to offset arbitrated safety net adjustments.

16.7 Employee doing work of a lower grade
Should an employee be temporarily transferred for a period not exceeding one week to perform a class of work as set out in this clause, of this award carrying a lesser minimum rate of wage than at which the employee is usually employed, the employee shall not during such temporary transfer suffer any reduction of the employee's usual wage.
17. SUPPORTED WAGES SYSTEM FOR EMPLOYEES WITH DISABILITIES
17.1 This clause defines the conditions which will apply to employees who because of the effects of a disability are eligible for a supported wage under the terms of this award. In the context of this clause, the following definitions will apply:
17.1.1 Supported wage system means the Commonwealth Government System to promote employment for people who cannot work at full award wages because of a disability, as documented in Supported Wage System: Guidelines and Assessment Process.
17.1.2 Accredited assessor means a person accredited by the management unit established by the Commonwealth under the supported wage system to perform assessments of an individual's productive capacity within the supported wage system.
17.1.3 Disability support pension means the Commonwealth pension scheme to provide income security for persons with a disability as provided under the Social Security Act 1991, as amended from time to time, or any successor to that scheme.
17.1.4 Assessment instrument means the form provided for under the supported wage system that records the assessment of the productive capacity of the person to be employed under the supported wage system.
17.2 Eligibility criteria
17.2.1 Employees covered by this clause will be those who are unable to perform the range of duties to the competence level required within the class of work for which the employee is engaged under this award, because of the effects of a disability on their productive capacity and who meet the impairment criteria for receipt of a Disability Support Pension.
17.2.2 (The clause does not apply to any existing employee who has a claim against the employer which is subject to the provisions of workers' compensation legislation or any provision of this award relating to the rehabilitation of employees who are injured in the course of their current employment.)
17.2.3 The award does not apply to employers in respect of their facility, programme, undertaking, service or the like which receives funding under the Disability Services Act 1986 and fulfils the dual role of service provider and sheltered employer to people with disabilities who are in receipt of or are eligible for a disability support pension, except with respect to an organisation which has received recognition under s.10 or under s.12A of the Act, or if a part only has received recognition, that part.
17.3 Supported wage rates
17.3.1 Employees to whom this clause applies shall be paid the applicable percentage of the minimum rate of pay prescribed by this award for the class of work which the person is performing according to the following schedule:

17.3.2 (Provided that the minimum amount payable shall be not less than $53 per week).
17.3.3 *Where a person's assessed capacity is 10%, they shall receive a high degree of assistance and support.
17.4 Assessment of capacity
For the purpose of establishing the percentage of the award rate to be paid to an employee under this award, the productive capacity of the employee will be assessed in accordance with the supported wage system and documented in an assessment instrument, by either:
17.4.1 the employer and a union party to the award, in consultation with the employee, or, if desired by any of these;
17.4.2 the employer and an accredited assessor from a panel agreed by the parties to the award and the employee.
17.5 Lodgement of assessment instrument
17.5.1 All assessment instruments under the conditions of this clause, including the appropriate percentage of the award wage to be paid to the employee, shall be lodged by the employer with the Registrar of the Australian Industrial Relations Commission.
17.5.2 All assessment instruments shall be agreed and signed by the parties to the assessment, provided that where a union which is party to the award, is not a party to the assessment, it shall be referred by the Registrar to the union by certified mail and shall take effect unless an objection is notified to the Registrar within ten working days.
17.6 Review of assessment
The assessment of the applicable percentage should be subject to annual review or earlier on the basis of a reasonable request for such a review. The process of review shall be in accordance with the procedures for assessing capacity under the supported wage system.
17.7 Other terms and conditions of employment
Where an assessment has been made, the applicable percentage shall apply to the wage rate only. Employees covered by the provisions of the clause will be entitled to the same terms and conditions of employment as all other workers covered by this award paid on a pro rata basis.
17.8 Workplace adjustment
An employer wishing to employ a person under the provisions of this clause shall take reasonable steps to make changes in the workplace to enhance the employee's capacity to do the job. Changes may involve re-design of job duties, working time arrangements and work organisation in consultation with other workers in the area.
17.9 Trial period
17.9.1 In order for an adequate assessment of the employee's capacity to be made, an employer may employ a person under the provisions of this clause for a trial period not exceeding twelve weeks, except that in some cases additional work adjustment time (not exceeding four weeks) may be needed.
17.9.2 During that trial period the assessment of capacity shall be undertaken and the proposed wage rate for a continuing employment relationship shall be determined.
17.9.3 The amount payable to the employee during the trial period shall be $53 per week or such greater amount as is agreed from time to time between the parties (taking into account the Department of Social Security income test free area for earnings) and inserted into this award.
17.9.4 Work trials should include induction or training as appropriate to the job being trialed.
17.9.5 Where the employer and employee wish to establish a continuing employment relationship following the completion of the trial period, a further contract of employment shall be entered into based on the outcome of assessment under 17.4 hereof.
18. PAYMENT OF WAGES
18.1 Wages shall be paid weekly or by agreement fortnightly provided that the last two days' wages due may be kept in hand. Where wages are paid on a weekly basis the ordinary rate for the week shall be one half of the fortnightly rate of pay. Provided that deductions for unpaid absences shall be calculated at the hourly rate. Provided also that payment for overtime worked at country depots and outport installations within the week before the pay day need not be made until the succeeding pay day.
18.2 Where an employee's rostered day off (under the nine-day fortnight roster) falls on a pay day the employee shall be paid the wages not later than the next working day following the employee's rostered day off. Provided that if such pay day falls on a Friday wages will be paid on the employee's preceding working day.
18.3 An employee kept waiting for wages on pay day for more than a quarter of an hour after the usual time for ceasing work, shall be paid at overtime rates with a minimum of half an hour.
18.4 On or prior to pay day, the employer shall state to each employee in writing the amount of wages to which the employee is entitled, the amount of deductions made therefrom, and the net amount being paid to the employee.
18.5 An employer and an employee may agree that wages due to the employee be paid by cheque or into a bank account nominated by the employee.
18.6 It shall be a full discharge of the obligations and rights accruing from week to week under clause 19 of this award, if, in pursuance of an agreement made between the employer and an employee, a different method of wage payment is adopted averaging over a full shift cycle the payments normally accruing from shift work to a shift worker. This provision shall apply even if a shift worker fails for any reason to work a full shift cycle.
19. MIXED FUNCTIONS
19.1 An employee engaged under this award and who in any day or shift does work involving different rates of pay shall be paid the highest of such rates for the whole of the employee's ordinary working hours on that day or shift.
19.2 Where in any overtime period an employee is required to perform work involving different rates of pay, the employee shall be paid the highest of such rates for the whole of that overtime period.
19.3 The provisions of 19.1 and 19.2 hereof will apply to work involving different rates of pay performed by an employee on a holiday as prescribed in clause 30 - Public holidays, of this award.
19.4 The provisions of this clause shall not apply to the moving of vehicles in or around an employer's premises.
20. ALLOWANCES
20.1 District allowances
20.1.1 Queensland
20.1.1(a) In addition to the rates prescribed elsewhere in this award, an employee covered by this award shall, when employed in the Western District of Queensland as defined in 8.10 of this award, be paid a district allowance of $2.20 per week.
20.1.1(b) The allowance prescribed in 20.1.1(a) hereof shall be varied to give effect to any new standard adopted by the Queensland Industrial Relations Commission.
20.1.2 Western Australia
Subject to the provisions of this clause in addition to the wages prescribed in clause 16 - Classifications and wage rates, of this award, an employee shall be paid the following allowances when employed in the towns described hereunder:

20.1.3 Except as provided in 20.1.4 hereof, an employee who has:
20.1.3(a) a dependent shall be paid double the allowance prescribed in 20.1.2 hereof.
20.1.3(b) a partial dependent shall be paid the allowances prescribed in 20.1.2 hereof plus the difference between that rate and the amount such partial dependent is receiving byway of a district or location allowance.
20.1.4 Where an employee is provided with board and lodging by the employer, free of charge, such employee shall be paid 66 and 2/3% of the allowances prescribed in 20.1.2 hereof.
20.1.5 Subject to 20.1.3 hereof, junior employees, casual employees, part-time employees, apprentices receiving less than adult rate and employees employed for less than a full week shall receive that proportion of the location allowance as equates with the proportion of the location allowance that their wage for ordinary hours that week is to the adult rate for the work performed.
20.1.6 Where an employee is on annual leave or receives payment in lieu of annual leave the employee shall be paid for the period of such leave the district allowance to which the employee would ordinarily be entitled.
20.1.7 Where an employee is on long service leave or other approved leave with pay (other than annual leave) the employee shall only be paid district allowance for the period of such leave the employee remains in the district in which the employee is employed.
20.1.8 For the purpose of this clause:
20.1.8(a) Dependant shall mean:
20.1.8(a)(i) a spouse or de facto spouse; or
20.1.8(a)(ii) a child where there is no spouse or de facto spouse;
who does not receive a district or location allowance.
20.1.8(b) Partial dependant shall mean a dependent as prescribed in 20.1.8(a) hereof who receives a district or location allowance which is less than the location allowance prescribed in 20.1.2 hereof.
20.1.9 Where an employee is employed in a town or location not specified in this clause the allowance payable for the purpose of 20.1.2 hereof shall be such amount as may be agreed between the Australian Mines and Metals Association, the Confederation of Western Australian Industry and the Trades and Labor Council of Western Australia or, failing such agreement, as may be determined by the Commission. Provided that, pending any such agreement or determination, the allowance payable for that purpose shall be an amount equivalent to the district allowance in force under this award for that town or location on 1 June 1980.
20.1.10 Nothing herein contained shall have the effect of reducing any district allowance currently payable to any employee subject to the provision of this award whilst that employee as at 1 June 1980 remains employed by the present employer.
20.1.11 Subject to the making of a General Order pursuant to section 50 of the Act, that part of each location allowance representing prices shall be varied from the beginning of the first pay period commencing on or after the 1st day of July of each year in accordance with the annual percentage change in the Consumer Price Index (excluding housing), for Perth measured to the end of the immediately preceding March quarter, the calculation to be taken to the nearest ten cents.
20.1.12 The allowance prescribed for Argyle is equated to that at Kununurra as an interim allowance. Liberty is reserved to the parties to apply for a review of the allowance for Argyle in the light of changed circumstances occurring after the date of this order.
20.1.13 The allowance prescribed for Barrow Island shall be half the allowance prescribed by clause 8 of the Hydrocarbons and Gas (Mechanical and Electrical Trades) Barrow Island Award 2000 [PR900840 [AW805083]], which at the date of this order is $22.42 per week. Except for the location allowance prescribed under 20.1.2 hereof this clause shall not apply where they are inconsistent with the terms of clause 8 of the Hydrocarbons and Gas (Mechanical and Electrical Trades) Barrow Island Award 2000.
20.2 Meal allowance
20.2.1 Any employee required to work overtime for more than one and a half hours immediately after the usual finishing time, otherwise than because of the employee's own default or delay, shall be paid a meal allowance of $9.14.
20.2.2 Provided that, after each four hours overtime worked continuously and subsequent to the first one and a half hours an employee shall be entitled to a further meal allowance of $9.14 in respect of that four hours. To be eligible for each payment of a meal allowance an employee must continue to work after the relevant meal break.
20.2.3 A meal allowance of $9.14 shall be paid to an employee who is called in on any day earlier than 1½ hours before the time when (notwithstanding that in the case of a day worker such time is outside the spread of ordinary hours specified in clause 21 - Hours - day workers, of this award or in the case of a shift worker such time is earlier than the commencement of the employee's ordinary shift hours) the employee would have commenced work on that day had the employee not been so called in, and who thereby misses a meal which otherwise the employee would have partaken at the employee's home. Provided that this payment shall not apply in respect of changes to regular starting times for which at least seven days notice has been given.
20.2.4 Any employee who is called upon to work on a holiday shall be paid either:
20.2.4(a) where work continues for more than 9½ hours a meal allowance of $9.14 and after the next four hours of continuous work in excess of eight hours on any such day a further meal allowance of $9.14 and after each additional four hours continuous work thereafter a subsequent meal allowance of $9.14 provided the employee continues working after each such qualifying period; or
20.2.4(b) where the work is extended unexpectedly beyond the time when the employee would ordinarily be expected to partake of a meal on any such day, a meal allowance of $9.14 for the first such meal, $9.14 for the next meal and $9.14 for any subsequent meal.
20.2.5 A day worker, or a shift worker on other than seven day shifts, required to work on a Saturday or Sunday (not being a day on which the employee is ordinarily required to work) shall, after the first four hours of overtime work (provided the employee is required to work beyond the said four-hourly period) be paid $9.14.
This payment need not be made to an employee living in the same locality as the employee's workplace who can reasonably return home for a meal.
20.2.6 Notwithstanding the provisions of 20.2.3 and 20.2.4 hereof, a delivery driver required by the employer to commence work at or before 5.30 a.m. on a Saturday, Sunday or a public holiday as prescribed in clause 30 - Public holidays, of this award, shall be paid a meal allowance of $9.14.
20.2.7 Allowances under this clause shall not apply:
20.2.7(a) when the employer provides a suitable meal as an alternative to payment of the relevant allowance; and
20.2.7(b) when an employee receives expenses covering such meals under 20.3 hereof.
20.3 Travelling allowance
20.3.1 Where an employer transfers an employee from the employee's usual place of employment to another place of employment the employer shall reimburse an employee all fares and expenses reasonably incurred in going to and from such place for a period not exceeding six months.
20.3.2 Where an employee is required by the employer to travel as a passenger by any conveyance, the employee shall whilst so travelling be paid at ordinary rate to a maximum of twelve hours out of every 24 of such travelling except on Sundays or holidays when payment shall be at the rate of time and a half, provided that when a sleeping berth is provided by the employer for all-night travel the maximum travelling time to be paid shall be eight hours out of every 24.
20.3.3 Employees whose work necessitates their absence from home overnight shall be paid all expenses reasonably incurred by such absence, with a minimum payment of $39.53 per night or alternatively they shall be provided with reasonable meals and accommodation. Provided that where an employee travels by boat or other conveyance in which the ticket includes meals and bed the employee shall not be entitled to the said allowance.
20.3.4 Where an employee is transferred temporarily to work at a place which requires the employee to travel daily a greater distance from the employee's home than the distance to the usual place of employment, the employee shall be paid any additional fares and additional travelling time so incurred for a period not exceeding three months.
20.4 Uniform allowance
20.4.1 Where the employer requires a special uniform or such other apparel to be worn by an employee while on duty, and the employer does not supply and launder such uniform or apparel at its own expense, the employer shall reimburse the employee for any expense incurred by the employee in acquiring and laundering (once per week) such apparel.
20.4.2 Where the employer requires the wearing of overalls, gloves, aprons, footwear and wet weather clothing and the employer does not supply and launder such items at its own expense, the employer shall reimburse the employee for any expense incurred by the employee in acquiring and laundering (once per week) such apparel.
20.4.3 Any clothing or other items supplied in accordance with the provisions of 20.4.1 and 20.4.2 shall remain the property of the employer.
20.5 Gear and equipment allowance
All necessary gear and equipment shall be provided by and shall remain the property of the employer. However, where an employee provides their own gear and equipment, the employee will be reimbursed for the cost of such gear and equipment.
20.6 First aid
An employee holding a current first aid qualification from St. John Ambulance or similar body and appointed by the employer to perform first aid duty shall be paid in addition to the wages $12.92 for any week the employee is so appointed. The employer will reimburse the cost of fees for any courses necessary for any employee covered by this clause to obtain and maintain current the appropriate first aid qualification.
20.7 Log book allowance
Where a weekly employee is required to purchase a log book, the employee shall be reimbursed for the cost of the log book by the employer.
20.8 Training allowance
20.8.1 Where there is a need to develop vocational skills relevant to the enterprise and the industry through courses conducted by appropriate educational institutions and training providers, that training may be undertaken either on or off the job. Provided that if the training is undertaken during ordinary working hours the employee concerned shall not suffer any loss of pay. The employer shall not unreasonably withhold such paid training leave.
20.8.2 Any costs incurred in connection with the undertaking of training shall be reimbursed by the employer upon production of evidence of such expenditure.
20.8.3 Travel costs incurred by an employee undertaking training in accordance with this clause which exceed those normally incurred in travelling to and from work shall be reimbursed by the employer.
20.9 Licences
20.9.1 Where an employee, in the course of duties, is required by law to obtain a special licence to operate special equipment, the licence fee will be reimbursed by the employer.
20.9.2 Where an employee, who does not hold a driving licence to drive a motor vehicle on a public highway, is required to hold such a licence for the performance of work, the employer will reimburse the employee the cost of the first licence fee.
20.10 Accident pay - make-up of pay
20.10.1 An employer shall pay an employee accident make-up payment where the employee receives an injury at the place of employment for which weekly payment or compensation is payable by or on behalf of the employer pursuant to the provisions of the appropriate Workers Compensation Acts, as amended from time to time.
20.10.2 Accident make-up payment means a weekly payment of an amount being the difference between the weekly amount of compensation paid to the employee pursuant to the said appropriate Workers Compensation Act and the employee's appropriate 35 hour award rate, or, where the incapacity is for a lesser period than one week, the difference between the amount of compensation and the said award rate for that period.
20.10.3 An employer shall pay, or cause to be paid, accident make-up payment during the incapacity of the employee within the meaning of the said appropriate Act until such incapacity ceases or until the expiration of a period of 52 weeks from the date of injury, whichever event shall first occur.
20.10.4 The liability of the employer to pay accident make-up payment in accordance with this clause shall arise as at the date of the injury or accident in respect of which compensation is payable under the said appropriate Acts, and the termination of the employee's employment for any reason during the period of any incapacity shall in no way affect the liability of the employer to pay accident make-up payment as provided in this clause.
20.10.5 In the event that the employee receives a lump sum in redemption of weekly payments under the appropriate Acts, the liability of the employer to pay accident make-up payment as herein provided shall cease from the date of such redemption.
20.10.6 An employer may at any time apply to the Australian Industrial Relations Commission for exemption from the terms of this clause on the grounds that an accident make-up payment scheme proposed and implemented by the employer contains provisions generally not less favourable to the employees than the provisions of this clause.
PART 6 - HOURS OF WORK, BREAKS, OVERTIME, SHIFT WORK, WEEKEND WORK
21. HOURS - DAY WORKERS
21.1 Ordinary hours of work
21.1.1 The spread of ordinary hours of day workers shall be 70 hours per two week period to be worked between 6.30 a.m. to 5.30 p.m. Monday to Friday (with an unpaid lunch break of not less than 30 minutes and not more than one hour). By mutual agreement between an employer and the employees concerned, the spread of hours may be altered for all, or a section of, employees. Time worked within the mutually agreed spread of hours will not attract penalty payments. Provided, however, such agreement does not erode award conditions, is entered into without duress, is signed by both parties and is attached to the relevant employees' time and wages record.
21.1.2 By agreement between an employer and the majority of affected employees, the ordinary working hours for employees engaged in rural distribution operations may be rostered over any three consecutive days, Monday to Saturday inclusive unless some other mutually satisfactory arrangement is made between the employer and the employee concerned and the branch secretary where appropriate, provided that there shall be no requirement to exceed the maximum allowable driving hours. All work performed in excess of 35 hours in any such three days shall be paid at time and a half for the first two hours and double time thereafter.
21.1.3 The hours of starting and finishing work shall be fixed by the employer, but having been fixed shall not be altered without the provision of 24 hours notice.
21.2 Starting and finishing times
21.2.1 Where proper facilities are provided for signing on and off, work shall be deemed to have commenced when the employee signs on at the yard or depot and to finish when the employee signs off, unless some other mutually satisfactory arrangement is made between the employer and the employee concerned and the branch secretary where appropriate.
21.2.2 Where proper facilities for signing on and off are not provided, work shall be deemed to commence when the employee enters the yard or depot and to finish when the employee leaves the yard or depot.
21.2.3 Each employer shall fix starting and finishing times for the employees.
21.3 Alteration of starting times
21.3.1 Where an employer desires to vary or change the starting time for day work of an employee or employees, the employer shall give one week's notice of such variation or change to the employee or employees concerned and in the case of a group of employees post a notice of the intended change at the yard or depot.
21.3.2 Provided the employee is given at least ten hours off duty immediately before commencing or after ceasing shift work, a day worker may be transferred to or from shift work on 48 hours notice. In default of such notice the employee shall be paid overtime rates for all work done outside the employee's previous ordinary working hours within 48 hours of the time the employee is notified of the change.
21.3.3 Where it is necessary to transfer a day worker to replace a shift worker who fails to report for duty or who for any reason is unable to continue the duties, this clause shall not apply, but the position shall be deemed to be covered by 25.11 of this award.
21.3.4 The ordinary hours of work may be worked on ten days each of seven hours or may be worked on nine days each of seven hours 47 minutes in accordance with the nine day fortnight roster.
21.4 Rostered days off
21.4.1 Rostered days off may be accumulated to a maximum of ten days over a 26 week period. Rosters shall be fixed in advance by mutual agreement between the employer and the employee and shall not be varied unless special circumstances arise.
21.4.2 All such accumulated days off shall be given and taken during or at the expiration of the 26 week period.
21.4.3 Detailed records of accumulated days must be kept by the employer and such details made available to the employee, or the employee's nominated representative, on request.
In fixing such rosters, rostered days off may be taken in advance before the employee has accrued the additional time to cover days off.
21.4.4 Provided that in the event that the employee ceases employment with the employer before accruing credits to cover the time taken in advance any time outstanding shall be deducted from moneys owed to the employee on termination of employment.
21.5 All work performed outside of the spread of hours contained in 21.1.1 hereof shall be paid at overtime rates and shall be deemed for the purpose of this clause to be part of the ordinary hours of work where the ordinary hours worked within the prescribed spread of hours in any week are less than 35.
22. MEAL BREAK - DAY WORKERS
22.1 On Monday to Friday an unpaid meal break of not less than 30 minutes shall be allowed between the fourth and sixth hour from the commencement of work. Provided that by agreement between an employer and the employee concerned, the meal break may be taken earlier where circumstances of the job so require. An employee shall not be required to work for more than five hours without a break for a meal.
22.2 If on instructions from the employer an employee is unable to have a full meal break between the fourth and sixth hour or the agreed time, the employee shall be paid double time until the full meal break is allowed.
22.3 A delivery driver who, in any one day is required to travel, and return from, a destination located in excess of 160 kilometres from the place of employment shall be allowed a paid meal break of 30 minutes.
23. REST BREAK
23.1 Subject to their observance of the employer's safety regulations, all employees shall be allowed a rest break of ten minutes during each period of at least four hours ordinary working time, and during each continuous period of at least four hours performed on Saturdays, Sundays and holidays.
23.2 Rest breaks shall be taken having regard to the work in progress and at times which minimise the interruption to work then being performed.
24. OVERTIME
24.1 Day workers
24.1.1 All time of duty in excess of and/or outside of the hours prescribed in clause 21 - Hours - day workers of this award shall be paid at the rate of time and a half for the first two hours on any one day and double time thereafter, such double time to continue until the completion of the overtime work.
23.1.2 All overtime shall be paid on the weekly rate of wage that the employee is being paid.
24.1.3 Each day's overtime shall stand alone and be paid for in addition to the ordinary weekly or casual wage, as the case may be.
24.1.4 As far as practicable, overtime shall be eliminated, but where necessary an employer may require an employee to work reasonable overtime at overtime rates and such employee shall work overtime in accordance with these requirements.
24.1.5 Provided that such overtime worked within the limitations of health and safety legislation pertaining to driving times.
24.2 Rest period after overtime
24.2.1 Subject to 24.2.2 and 24.2.3 hereof, when overtime is worked it shall be so arranged that employees have at least ten consecutive off hours duty between the work of successive days.
24.2.2 An employee, other than a casual employee, who works so much overtime between the termination of the employee's ordinary work on one day and the commencement of ordinary work on the next day that the employee has not had the rest period prescribed in 24.2.1 hereof shall, subject to this subclause, be released after completion of such overtime until the employee has had such rest period, without loss of pay for ordinary working time occurring during such absence. Provided that should an employee's rest period as aforesaid end within two hours of the employee's normal ceasing time the employee shall not be required to report for work on that day. If, on the instructions of the employer, such an employee resumes or continues to work without having had such rest period the employee shall be paid at double time until the employee is released from duty for such rest period and the employee shall then be entitled to be absent until the employee has had the rest period, without loss of pay for ordinary working time occurring during such absence.
24.2.3 Overtime worked in the circumstances specified in 24.3 hereof shall not be regarded as overtime for the purposes of this clause where the actual time worked is less than three hours on such recall or on each of such recalls. Provided that, where time worked on a recall or recalls in the circumstances specified in 24.3 hereof is less than three hours duration it shall be regarded as overtime for the purposes of this subclause only if the employee had responded to a recall after being contacted at home, response had involved the employee in an additional journey to and from the workplace and in the case of exceptional circumstances arising during the callback period the employee, if required, had worked further even though the employee had performed the job for which the employee was recalled.
24.3 Call back - Monday to Friday inclusive
An employee recalled to work overtime after leaving the employer's business premises (whether notified before or after leaving the premises) shall be paid for a minimum of four hours work at the appropriate rate for each time the employee is so recalled. Provided that, except in the case of unforeseen circumstances arising, the employee shall not be required to work the full four hours if the job the employee was recalled to perform is completed within a shorter period. This subclause shall not apply in cases where it is customary for an employee to return to the employer's premises to perform a specified job outside the employee's ordinary working hours where the overtime is continuous (subject to a reasonable meal break) with the completion or commencement of ordinary working time.
24.4 Travelling time - call ins
24.4.1 An employee who is contacted on any day of the week at home and responds to a call in to work involving the employee in an additional trip to and from the work place shall be paid one hour at the employee's ordinary-time rate of pay for travelling time irrespective of the distance travelled.
24.4.2 This clause shall not apply in cases where it is customary for an employee to return to the employer's premises to perform a specific job outside the employee's ordinary working hours, or where the overtime is continuous (subject to a reasonable meal break) with the completion or commencement of ordinary working time, or in the case of planned overtime (on weekends, public holidays, etc.) where notice of such overtime is given before the employee leaves the work place.
24.5 Cancellation of overtime
24.5.1 If notice cancelling a previous instruction to work overtime is given to an employee before the employee leaves the workplace, a penalty payment shall not be payable.
24.5.2 If notice cancelling the instruction is sent or telephoned to the employee's registered address before the employee would normally have left to commence work, the employee shall be paid a minimum of:
24.5.2(a) two hours at the employee's ordinary-time rate in the case of a week-day overtime cancellation, and
24.5.2(b) four hours at the employee's ordinary-time rate in the case of a weekend work or holiday work cancellation.
Provided that an additional penalty shall not be payable if the employee is not at the registered address when notice of cancellation is delivered or telephoned and the employee subsequently reports for work.
24.5.3 If notice of cancellation provided in 24.5.2 hereof is not delivered or telephoned to the employee's registered address at least one hour before the employee would normally leave to commence work and the employee would normally be expected to partake of a meal at the work place during the period of overtime now cancelled, the employee shall be entitled to a meal allowance of $9.14.
24.5.4 For the purpose of this clause registered address shall mean the address recorded by the employer.
24.6 Time off in lieu of overtime
24.6.1 Time off in lieu of payment for overtime may occur with the written agreement of the employer and the employee concerned. Such time off may accumulate to a maximum of 70 hours within a twelve month period. The time off in lieu shall be taken at a mutually convenient time having regard to the operational needs of the workplace.
24.6.2 All accumulated hours shall be given and taken within, or at the expiration of the twelve months in which they accrued, provided that any time which may not have been taken upon termination of employment shall be paid to the employee at that time.
24.6.3 Detailed records of accumulated hours shall be kept by the employer and provided to the employee or the employee's nominated representative upon request.
24.6.4 Time off in lieu of overtime shall equate to the overtime payment the employee would have received. That is to say, 1.5 hours time off shall accumulate for each hour of overtime worked when the overtime rate is time and a half, and two hours time off shall accumulate when the overtime rate is double time.
24.7 Saturday work - day workers
24.7.1 For all work done on a Saturday the rates of pay shall be time and a half for the first two hours and double time thereafter.
24.7.2 An employee required to report for work on Saturday shall be paid for at least four hours at the appropriate rate for each attendance.
24.8 Sunday work - day workers
24.8.1 For all work done on a Sunday the rates of pay shall be double time, such double time to continue until the employee is relieved from duty. An employee required to report for work on a Sunday shall be paid for at least four hours at double time for each attendance.
24.8.2 An employee, other than a casual employee, who works on a Sunday and (except for meal breaks) immediately thereafter continues such work shall on being relieved from duty be entitled to be absent until the employee has had the period of rest as provided under 24.2 hereof without reduction of pay for ordinary time of duty occurring during such absence.
24.9 Transport of employees
24.9.1 When an employee, after having worked overtime or a shift for which the employee has not been regularly rostered, finishes work at a time when the employee's normal means of transport or reasonable means of public transport are not readily available the employer shall pay the employee at the ordinary time-rate of the employee's current wage for the time reasonably occupied in reaching the employee's home. Provided that this clause shall not apply to those employees receiving the allowance prescribed in 25.5 of this award.
24.9.2 When an employee, not having been notified before leaving the employer's business premises, is called in before the employee's usual commencing time to work overtime, or a shift, for which the employee has not been regularly rostered and at a time when the employee's normal means of transport or reasonable means of transport are not available, the employer shall pay the employee at the ordinary rate for the time reasonably occupied in reaching the place of work.
24.10 Telephoning
24.10.1 Telephoning for instructions
Subject to a minimum of three hours pay where an employee complies with a direction to telephone for instruction in connection with overtime work the employee shall be paid at the employee's ordinary-time rate from that telephone call until either the employee:
24.10.1(a) is given further direction to telephone later for instructions; or
24.10.1(b) is told a definite time at which the employee is to commence work; or
24.10.1(c) is released.
24.10.2 Where it becomes necessary for the employee to make a number of telephone calls at intervals determined by an authorised supervisor, the employee is to receive a minimum of three hours payment at the employee's ordinary-time rate for each such telephone call, provided that no payment will be made for any telephone call within three hours of the last preceding telephone call. Provided further that when an employee commences work, all payments due under this clause shall cease.
24.10.3 An employee, other than an employee engaged in continuous shift work, who on any day of the week responds to a telephone call (not being a telephone call in respect of which a payment is made under the provisions of 24.10.1 hereof) made to the employee at home requiring the employee to report for work earlier than the employee's next scheduled starting time shall, if the employee's telephone rental is not paid by the employer, receive a payment of $9.14.
24.11 Standing by
Subject to any custom now prevailing under which an employee is required regularly to hold in readiness for a call-back, an employee required to hold in readiness to work after ordinary hours shall until released be paid standing by time at the employee's ordinary time rate from the time from which the employee is so told to hold in readiness.
25. SHIFT WORK
25.1 Definition
25.1.1 Shift work means work extending for at least two weeks and performed either in daily recurrent periods wholly or partly between the hours of 5.30 p.m. and 7.00 a.m., or in regular rotating periods.
For the purpose of this definition the present system of shifts operating at Bankstown Aerodrome, New South Wales, where day work is carried out seven days a week on a roster, shall be regarded as shift work. This paragraph shall apply only to employees at Bankstown Aerodrome, New South Wales.
25.1.2 Afternoon shift means any shift finishing after 6.00 p.m. and at or before midnight.
25.1.3 Night shift means any shift finishing subsequent to midnight, and at or before 8.00 a.m.
25.1.4 Permanently working. An employee shall be deemed to be and to have been permanently working an afternoon shift or night shift or combination of afternoon and night shifts if:
25.1.4(a) the employee works on an afternoon or night shift or combination of such shifts without rotating or alternating with another shift or with day work, so as to give the employee at least one-third of the working time off that afternoon or night shift or combination of such shifts in each shift cycle; or
25.1.4(b) the employee remains on an afternoon or night shift only, or a combination of afternoon and night shifts, for a longer period than four consecutive weeks; or
25.1.4(c) the employee is specifically engaged to work on an afternoon or night shift only, or on a combination of afternoon and night shifts only.
25.1.5 Continuous work means work carried on with consecutive shifts of employee's throughout the 24 hours of each of at least six consecutive days without interruption except during breakdowns or meal breaks or due to unavoidable causes beyond the control of the employer. Non-continuous shift work means shift work other than continuous shift work as defined.
25.1.6 Aircraft refuelling shifts means work arranged on a system of rostered shifts for the purpose of refuelling and/or servicing aircraft whether or not shifts are worked successively through the 24 hours of each day or overlap or are worked on all the days of the week.
25.1.7 Any other shift means day work alternating with an afternoon or night shift.
25.2 Hours - five-day non-continuous shift work
The provisions of clause 21 - Hours - day workers of this award shall apply to employees on five-day non-continuous shift work.
25.3 Five-day continuous shift work
25.3.1 Shift work shall be arranged to provide for an average of 35 ordinary hours of work per week over the span of the shift cycle.
25.3.2 In the arrangement of rosters for five-day continuous shift workers the following provisions shall apply:
25.3.2(a) Shifts will be of eight hours duration.
25.3.2(b) Days off may be rostered off progressively over shift cycles or accumulated to a maximum of ten days over a 26 week period. Such days off will be calculated on the basis of time actually worked.
25.3.3 Shift workers will be paid for time worked calculated in accordance with their shift rosters.
25.3.4 Except at the regular change over of shifts, an employee shall not be required to work more than one shift in each 24 hours.
25.3.5 Twenty minutes shall be allowed to shift workers each shift for crib, which shall be counted as time worked.
25.4 Seven-day non-continuous shift work
25.4.1 Shift work shall be arranged to provide for an average of 35 ordinary hours of work per week over the span of the shift cycle provided that the ordinary hours of any one shift shall not be more than eight. Provided further that by agreement between an employer and the majority of affected employees, different limitations of ordinary hours may be made to meet domestic shift rosters.
25.4.2 Days off may be rostered off progressively over shift cycles or accumulated to a maximum of ten days over a 26 week period. Such days off will be calculated on the basis of time actually worked.
25.4.3 Shift workers will be paid for time worked calculated in accordance with their shift rosters.
25.5 Seven-day continuous shift work
25.5.1 Shift work shall be arranged to provide for an average of 35 ordinary hours of work per week over the span of the shift cycle.
25.5.2 Shifts will be of eight hours duration.
25.5.3 Days off may be accumulated to a maximum of ten days over a 26 week period. Such days off will be calculated on the basis of time actually worked.
25.6 Hours - other than continuous work
25.6.1 This clause shall apply to shift workers not upon continuous work as hereinbefore defined. The ordinary hours of such shift work shall be arranged to provide for an average of 35 ordinary hours per week.
25.6.2 Ordinary hours shall be worked continuously, except for meal breaks at the discretion of the employer. An employee shall not be required to work for more than five hours without a break for a meal.
25.6.3 Except at regular change-over of shifts, an employee shall not be required to work more than one shift in each 24 hours.
25.7 Aircraft refuelling shifts
25.7.1 Shift work shall be arranged to provide for an average of 35 ordinary hours of work per week over the span of the shift cycle.
25.7.2 Employees may be rostered by the employer to work at such times as may be required provided that the ordinary hours of employment shall not, without payment for overtime, exceed:
25.7.2(a) eight hours in any one shift; or
25.7.2(b) 70 hours in any two consecutive weeks.
25.7.3 There shall be a minimum interval between shifts of at least ten hours off duty.
25.7.4 While on afternoon or night shifts, Monday to Sunday inclusive, employees shall be paid 15% above the ordinary-time rate. For the ordinary shift hours, Monday to Friday inclusive, employees shall be paid 10% above the ordinary-time rate.
25.7.5 Thirty minutes shall be allowed to shift workers in each shift for crib, which shall be counted as time worked.
25.7.6 For each pay week in which the employee's roster requires that the employee commences ordinary hours of work on more than two different starting times, an aerodrome attendant on shift work shall be paid $1.40 for each such starting time in excess of two at which the employee is required to commence duty in that pay week.
25.7.7 An employee required to hold himself in readiness for call back shall, until released, be paid standing-by time at ordinary rates from the time the employee is so to hold himself in readiness.
25.8 Shift allowances
For the ordinary hours of shift, shift workers shall be paid the following extra percentages of the rate prescribed for their respective classifications.

25.9 Saturday work
For the ordinary shift hours worked between midnight on Friday and midnight on Saturday the rates of wages prescribed by clauses 16 - Classifications and wage rates and 20.1 - District allowances, of this award shall be increased by 50%, being cumulative upon all other shift premiums prescribed in 25.8 hereof.
25.10 Sunday work
For ordinary shift hours worked between midnight on Saturday and midnight on Sunday, the rates of wages prescribed by clauses 16 - Classifications and wage rates and 20.1- District allowances, of the award shall be increased by 100%, being cumulative upon all other shift premiums prescribed in 25.8 hereof.
25.11 Rate when shift extends beyond midnight
Notwithstanding anything herein contained, each shift shall be paid for at the rate applicable to the day on which the major portion of the shift is worked.
25.12 Crib time
All shifts of more than four hours shall include a paid crib time of 30 minutes, to be taken at a time convenient to the work in hand. Provided that no employee shall be called upon to work a greater period than five hours without a crib time.
25.13 Work on a rostered day off
25.13.1 A shift worker who is rostered to work regularly on Sundays and holidays as part of the ordinary hours, shall be paid at the rate of double time for all work performed on the employee's rostered day off.
25.13.2 A seven day shift worker required to work on a rostered day off shall receive a minimum payment as for four hours of work. The provision of a minimum payment shall not apply where the work on such day is continuous with the commencement or completion of the employee's ordinary shift.
25.14 Rostered day off falling on a holiday
An employee whose rostered day off falls on a holiday Monday to Friday inclusive to which a day worker is entitled as provided in clause 30 - Public holidays, of this award and who is not required to work shall receive a day's pay at ordinary time rate in addition to the employee's weekly wage.
25.15 Lack of public transport
In addition to the allowances prescribed in 25.8 hereof an employee who works a rostered shift the ordinary hours of which extend beyond midnight and finish when reasonable means of public transport are not readily available, shall be paid an allowance of $0.99 for each such shift. This allowance shall be payable only in circumstances where public transport normally available during the day and evening hours is not available after midnight. The provisions of this subclause shall have no application in centres where public transport does not exist. Provided that this subclause shall not apply to aerodrome attendants.
25.16 Transfer to existing shift rosters
Forty-eight hours notice of any change of shift shall be given to an employee in default of which overtime rates shall be paid for work done outside the ordinary shift hours within 48 hours of the time the employee is notified of the change.
25.17 Delivery shifts
The ordinary hours of shift workers engaged on deliveries shall be worked in five days Monday to Friday inclusive, provided that a shift commenced before midnight Friday and extending into Saturday shall be deemed to be worked within this period from Monday to Friday. No shifts for deliveries on Saturdays and Sundays shall be arranged without further discussion with the appropriate branch of the union. This subclause shall have no effect in regard to bridging operations or transfers of stock.
25.18 Variations of rosters
The method of working shifts and the time of commencing and finishing shifts once having been determined may be varied by agreement between the employer and the majority of affected employees to suit the circumstances of the establishment, or in the absence of agreement by seven days notice of alteration given by the employer to the employee.
25.19 Overtime
For all time worked in excess of or outside the ordinary working hours prescribed by this award shift workers shall be paid:
25.19.1 if employed on seven-day shift work, i.e. employees working rostered shifts necessitating regular rostered Sunday and holiday work as part of their ordinary hours, at the rate of double time; or
25.19.2 if employed on other shift work:
25.19.2(a) at the rate of double time on Sundays;
25.19.2(b) at the rate of time and a half for the first two hours and double time thereafter, on all other days except in each case when the time is worked:
25.19.2(b)(i) by arrangement between the employees themselves; or
25.19.2(b)(ii) for the purpose of effecting the customary rotation of shifts.
Where a relief employee is unable to attend for duty the employee shall wherever practicable give at least eight hours notice of the employees' inability to attend. All overtime shall be paid on the weekly rate of wage that the employee is being paid. Provided that the weekly rate shall not be deemed to include any shift allowance prescribed in this award.
Provided however a seven-day shift worker shall not be paid for overtime worked at any time at a lesser rate than is payable to an employee performing normal shift at such time.
25.20 Cancellation of overtime - shift workers
25.20.1 If notice cancelling a previous instruction to work overtime is given to an employee before the employee leaves the workplace, a penalty payment shall not be payable.
25.20.2 If notice cancelling the instruction is sent or telephoned to the employee's registered address before the employee would normally have left to commence work, the employee shall be paid a minimum of:
25.20.2(a) two hours at the employee's ordinary time rate in the case of overtime scheduled for a day on which the employee is rostered to work an ordinary shift; and
25.20.2(b) four hours at the employee's ordinary time rate in the case of overtime scheduled on a day on which the employee is not rostered to work an ordinary shift.
Provided that an additional penalty shall not be payable if the employee is not at the registered address when notice of cancellation is delivered or telephoned and the employee subsequently reports for work.
25.20.3 If notice of cancellation provided in 25.20.2 hereof is not delivered or telephoned to the employee's registered address at least one hour before the employee would normally leave to commence work and the employee would normally be expected to partake of a meal at the work-place during the period of overtime now cancelled, the employee shall be entitled to a meal allowance of $9.14.
25.20.4 For the purpose of this clause registered address shall mean the address recorded by the employer.
25.21 Call-in for early start
A seven day shift worker who, not having been notified before leaving the employer's business premises is called in to start work at a time less than four hours before the commencing time of the employee's ordinary hours of work shall for the first four hours from the time the employee commenced work be paid at the rate of double time; such double time shall be in lieu of the rate prescribed in this award for the portion of the employee's ordinary hours of work occurring during the said four hours. Thereafter the employee will revert to the ordinary shift rate.
25.22 Travelling time - call ins
A shift worker who is contacted on any day of the week at home and responds to a call-in to work involving the employee in an additional trip to and from the workplace shall be paid one hour at the employee's ordinary time rate of pay for travelling time, irrespective of the distance travelled.
25.23 Christmas Day - shift workers
When 25 December falls on a Saturday or Sunday and a substituted day is proclaimed to be observed as the holiday, the following will apply:
Work on 25 December will attract the public holiday penalty and, where the employee also works on the substituted day, no penalty will apply. This only applies to work actually performed on 25 December and the substituted day will only be observed for purposes of payment on rostered days off.
25.24 Rest period before or after overtime
25.24.1 Subject to the provisions of this subclause, when overtime is necessary it shall be so arranged, wherever practicable, that a shift employee has a ten hour rest period between shifts worked on successive days.
25.24.2 The union, the employers and their employees will cooperate in establishing work arrangements which will provide, if practicable, for a shift employee who works so much overtime between the termination of the employee's ordinary shift on one day and the commencement of the employee's ordinary shift on the next day that the employee has not had at least ten consecutive hours off duty between those times, to be released after completion of such overtime until the employee has had ten consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
25.24.3 Except for the occasion when a shift employee exchanges shifts with another shift employee, with the employer's approval, and without limiting the scope of the provisions of this clause, overtime required to provide necessary shift coverage will be shared between the employees of the offgoing shift and the oncoming shift.
PART 7 - LEAVE OF ABSENCE AND PUBLIC HOLIDAYS
26. ANNUAL LEAVE
26.1 Except as hereinafter provided all weekly employees, after each twelve months continuous service with an employer, shall be granted four weeks leave on full pay.
26.1.1 In addition to the leave hereinbefore prescribed, seven-day shift workers, that is employees working rostered shifts necessitating regular rostered Sunday and holiday work as part of their ordinary hours after each twelve months continuous service shall be given an extra week's leave provided that where an employee is engaged for part only of the twelve monthly period as a seven-day shift worker the extra leave to which the employee shall be entitled shall be the same proportion of a week as the proportion which the time the employee spent as a seven-day shift worker during the period bears to a year.
26.1.2 An employee whose services are terminated for any cause whatsoever, or who leaves the employment in a qualifying period for annual leave, shall be entitled to the cash equivalent of such leave in respect of the period worked in the proportion which that period bears to a year.
26.2 Broken leave
The annual leave shall be given and taken in a continuous period or, if the employee and the employer so agree, in two separate periods and not otherwise.
26.3 Short-term annual leave
An employee may request and, with the consent of the employer, take short-term annual leave, not exceeding four days in any calendar year, at a time or times separate from any of the periods determined in accordance with 26.2.
26.4 Annual leave in advance
26.4.1 An employer may grant to an employee annual leave or, subject to 26.2 of this clause, a part thereof before the right to the leave has fully accrued due, but where the leave or part thereof is so taken, a further period of annual leave shall not commence to accrue until after the expiration of the twelve months in respect of which the leave or part leave was granted in advance.
26.4.2 Where the annual leave or part thereof has been granted to an employee pursuant to this clause before the right to the leave has accrued due; and
26.4.2(a) the employee subsequently leaves or is discharged before completing the twelve months continuous service in respect of which the leave or part leave was granted; and
26.4.2(b) the sum paid by the employer to the employee for the leave or part leave taken in advance exceeds the sum which the employer is required to pay the employee under 26.1.2 of this clause the employer shall not be liable to make any payments to the employee and shall be entitled to deduct the amount of such excess, but excluding any sums paid for any of the holidays prescribed by clause 30 - Public holidays, of this award from any remuneration payable to the employee upon termination of the employment.
26.5 Payment for annual leave
26.5.1 An employee before going on annual leave shall be paid therefore at the rate at which the employee was ordinarily employed prior to the commencement of leave.
26.5.2 Notwithstanding the above paragraph an employee classified under classification 16.2 - Delivery vehicles (products), of this award, shall be paid before going on annual leave at the higher rate when the employee has worked on a higher tonnage vehicle for a period of four weeks or more during the preceding six months. It shall not be a requirement that the period of four weeks be consecutive but shall cover a period of 28 calendar days or twenty working days in the six months period.
26.5.3 An employee proceeding on annual leave in accordance with the provisions of this clause and not in receipt of weekly pay equivalent to the employee's weekly wage rate prescribed in clause 16 - Classification and wage rates, of this award plus 22½% will have the employee's pay increased to that amount whilst on annual leave but not otherwise. Provided that an employee whose services are terminated (either by the employee or by the employer) after having accrued a full year's entitlement of annual leave shall receive the above payments in respect of that entitlement; provided further that pro-rata payments in lieu of annual leave on termination of employment shall be paid for only at the employee's ordinary-time rate of pay.
26.6 Leave to be given and taken
26.6.1 Annual leave shall be granted as soon as practicable after accrual but not later than six months of its becoming due.
26.6.2 At least six months notice shall be given of the commencement of annual leave, provided that any employee and the employer may agree that less than six month's notice may be given in individual cases.
26.7 Except as provided in 26.1.2 hereof, payment shall not in any circumstances be made in lieu of annual leave.
26.8 It shall be an offence for any employee who is on leave to accept other employment during the period of annual leave and it shall be an offence for any employer to knowingly engage a worker who is on annual leave.
26.9 Subject to this clause the annual leave prescribed by this clause shall be exclusive of any of the holidays prescribed by clause 30 - Public holidays, of this award, and if any such holiday falls within an employee's period of annual leave and is observed on a day which in the case of that employee would have been an ordinary working day either there shall be added to the period of annual leave time equivalent to the ordinary time which the employee would have worked if such day had not been a holiday, or else by mutual agreement the employee may work such equivalent time, in which case the employee shall be paid therefore at the appropriate rate prescribed by 30.5 of this award. Where a holiday falls as aforesaid and the employee fails, without reasonable cause proof whereof shall be upon the employee, to attend for work at the employee's ordinary starting time on the working day immediately following the last day of the period of annual leave, the employee shall not be entitled to be paid for any such holiday.
27. PERSONAL LEAVE
The provisions of this clause apply to full-time and regular part-time employees, but do not apply to casual employees.
27.1 Amount of paid personal leave
27.1.1 Paid personal leave will be available to an employee when they are absent due to
27.1.1(a) personal illness or injury (sick leave); or
27.1.1(b) for the purposes of caring for an immediate family or household member who is sick and requires the employee's care and support (carer's leave); or
27.1.1(c) bereavement on the death of an immediate family or household member (bereavement leave).
27.1.2 Personal leave of:
27.1.2(a) 56 hours will be available in the first year of service;
27.1.2(b) 77 hours will be available per annum in the second and subsequent years of service.
27.1.3 In any year unused personal leave accrues at the rate of the lesser of:
27.1.3(a) 56 hours less the amount of sick leave taken from the current year's personal leave entitlement in that year; or
27.1.3(b) the balance of that year's unused personal leave.
27.1.4 Personal leave may accumulate to a maximum of 539 hours.
27.2 Immediate family or household
27.2.1 The entitlement to use personal leave for the purposes of carer's or bereavement leave is subject to the person being either:
27.2.1(a) a member of the employee's immediate family; or
27.2.1(b) a member of the employee's household.
27.2.2 The term immediate family includes:
27.2.2(a) spouse (including a former spouse, a de facto spouse and a former de facto spouse) of the employee. A de facto spouse means a person of the opposite sex to the employee who lives with the employee as his or her husband or wife on a bona fide domestic basis; and
27.2.2(b) child or an adult child (including an adopted child, a step child or an ex-nuptial child), parent, grandparent, grandchild or sibling of the employee or spouse of the employee.
27.3 Sick leave
27.3.1 An employee is entitled to use up to 35 hours of the current year's personal leave entitlement as sick leave in the first year of service and 56 hours in the second and subsequent years of service.
27.3.2 An employee is entitled to use accumulated personal leave for the purposes of sick leave where the current year's sick leave entitlement has been exhausted.
27.3.3 An employee shall provide the employer when requested with a certificate from a qualified medical practitioner after two single absences per any one year of service.
27.4 Bereavement leave
27.4.1 An employee is entitled to use up to 21 hours personal leave as bereavement leave on each occasion.
27.4.2 Where an employee has exhausted all personal leave entitlements, including accumulated entitlements, they will be entitled to 21 hours unpaid bereavement leave.
27.4.3 The entitlement to bereavement leave is subject to the production of evidence to the reasonable satisfaction of the employer.
27.4.4 A full-time employee is entitled to use up to 21 hours personal leave as bereavement leave on each occasion, and on production of satisfactory evidence, of the death outside Australia of either a member of the employee's immediate family or household, where the employee travels outside Australia to attend the funeral.
27.5 Carer's leave
27.5.1 An employee is entitled to use up to 35 hours personal leave each year as carer's leave.
27.5.2 The employee shall, if required, establish by production of a medical certificate or statutory declaration, the illness of the person concerned.
27.5.3 An employee may take unpaid carer's leave by agreement with the employer.
28. PARENTAL LEAVE
Subject to the terms of this clause employees are entitled to maternity, paternity and adoption leave and to work part-time in connection with the birth or adoption of a child.
The provisions of this clause apply to full-time, part-time and eligible casual employees, but do not apply to other casual employees.
An eligible casual employee means a casual employee:
(a) employed by an employer on a regular and systematic basis for several periods of employment or on a regular and systematic basis for an ongoing period of employment during a period of at least 12 months; and
(b) who has, but for the pregnancy or the decision to adopt, a reasonable expectation of ongoing employment.
For the purposes of this clause, continuous service is work for an employer on a regular and systematic basis (including any period of authorised leave or absence).
An employer must not fail to re-engage a casual employee because:
(a) the employee or employee's spouse is pregnant; or
(b) the employee is or has been immediately absent on parental leave.
The rights of an employer in relation to engagement and re-engagement of casual employees are not affected, other than in accordance with this clause.
An eligible casual employee employed by their current employer, on or prior to 1 January 1998, shall be entitled to parental leave under the term of the award as of 4 July 2001.
An eligible casual employee employed on or after 4 July 2001 shall be entitled to parental leave under the term of the award as of 4 July 2002.
28.1 Definitions
28.1.1 For the purpose of this clause child means a child of the employee under the age of one year except for adoption of a child where child means a person under the age of five years who is placed with the employee for the purposes of adoption, other than a child or step-child of the employee or of the spouse of the employee or a child who has previously lived continuously with the employee for a period of six months or more.
28.1.2 Subject to 28.1.3 hereof, in this clause, spouse includes a de facto or former spouse.
28.1.3 In relation to 28.5 hereof, spouse includes a de facto spouse but does not include a former spouse.
28.2 Basic entitlement
28.2.1 After twelve months continuous service, parents are entitled to a combined total of 52 weeks unpaid parental leave on a shared basis in relation to the birth or adoption of their child. For females, maternity leave may be taken and for males, paternity leave may be taken. Adoption leave may be taken in the case of adoption.
28.2.2 Subject to 28.3.6 hereof, parental leave is to be available to only one parent at a time, in a single unbroken period, except that both parents may simultaneously take:
28.2.2(a) for maternity and paternity leave, an unbroken period of up to one week at the time of the birth of the child;
28.2.2(b) for adoption leave, an unbroken period of up to three weeks at the time of placement of the child.
28.3 Maternity leave
28.3.1 An employee must provide notice to the employer in advance of the expected date of commencement of parental leave. The notice requirements are:
28.3.1(a) of the expected date of confinement (included in a certificate from a registered medical practitioner stating that the employee is pregnant) - at least ten weeks;
28.3.1(b) of the date on which the employee proposes to commence maternity leave and the period of leave to be taken - at least four weeks.
28.3.2 When the employee gives notice under 28.3.1(a) hereof the employee must also provide a statutory declaration stating particulars of any period of paternity leave sought or taken by her spouse and that for the period of maternity leave she will not engage in any conduct inconsistent with her contract of employment.
28.3.3 An employee will not be in breach of this clause if failure to give the stipulated notice is occasioned by confinement occurring earlier than the presumed date.
28.3.4 Subject to 28.2.1 hereof and unless agreed otherwise between the employer and employee, an employee may commence parental leave at any time within six weeks immediately prior to the expected date of birth.
28.3.5 Where an employee continues to work within the six week period immediately prior to the expected date of birth, or where the employee elects to return to work within six weeks after the birth of the child, an employer may require the employee to provide a medical certificate stating that she is fit to work on her normal duties.
28.3.6 Special maternity leave
28.3.6(a) Where the pregnancy of an employee not then on maternity leave terminates after 28 weeks other than by the birth of a living child, then the employee may take unpaid special maternity leave of such periods as a registered medical practitioner certifies as necessary.
28.3.6(b) Where an employee is suffering from an illness not related to the direct consequences of the confinement, an employee may take any paid sick leave to which she is entitled in lieu of, or in addition to, special maternity leave.
28.3.6(c) Where an employee not then on maternity leave suffers illness related to her pregnancy, she may take any paid sick leave to which she is then entitled and such further unpaid special maternity leave as a registered medical practitioner certifies as necessary before her return to work. The aggregate of paid sick leave, special maternity leave and parental leave, including parental leave taken by a spouse, may not exceed 52 weeks.
28.3.7 Where leave is granted under 28.3.4 hereof, during the period of leave an employee may return to work at any time, as agreed between the employer and the employee provided that time does not exceed four weeks from the recommencement date desired by the employee.
28.4 Paternity leave
28.4.1 An employee will provide to the employer at least ten weeks prior to each proposed period of paternity leave, with:
28.4.1(a) a certificate from a registered medical practitioner which names his spouse, states that she is pregnant and the expected dated of confinement, or states the date on which the birth took place; and
28.4.1(b) written notification of the dates on which he proposes to start and finish the period of paternity leave; and
28.4.1(c) a statutory declaration stating:
28.4.1(c)(i) he will take that period of paternity leave to become the primary care-giver of a child;
28.4.1(c)(ii) particulars of any period of maternity leave sought or taken by his spouse; and
28.4.1(c)(iii) that for the period of paternity leave he will not engage in any conduct inconsistent with his contract of employment.
28.4.2 The employee will not be in breach of 28.4.1 hereof if the failure to give the required period of notice is because of the birth occurring earlier than expected, the death of the mother of the child, or other compelling circumstances.
28.5 Adoption leave
28.5.1 The employee will notify the employer at least ten weeks in advance of the date of commencement of adoption leave and the period of leave to be taken. An employee may commence adoption leave prior to providing such notice, where through circumstances beyond the control of the employee, the adoption of a child takes place earlier.
28.5.2 Before commencing adoption leave, an employee will provide the employer with a statutory declaration stating:
28.5.2(a) the employee is seeking adoption leave to become the primary care-giver of the child;
28.5.2(b) particulars of any period of adoption leave sought or taken by the employee's spouse; and
28.5.2(c) that for the period of adoption leave the employee will not engage in any conduct inconsistent with their contract of employment.
28.5.3 An employer may require an employee to provide confirmation from the appropriate government authority of the placement.
28.5.4 Where the placement of child for adoption with an employee does not proceed or continue, the employee will notify the employer immediately and the employer will nominate a time not exceeding four weeks from receipt of notification for the employee's return to work.
28.5.5 An employee will not be in breach of this clause as a consequence of failure to give the stipulated periods of notice if such failure results from a requirement of an adoption agency to accept earlier or later placement of a child, the death of a spouse, or other compelling circumstances.
28.5.6 An employee seeking to adopt a child is entitled to unpaid leave for the purpose of attending any compulsory interviews or examinations as are necessary as part of the adoption procedure. The employee and the employer should agree on the length of the unpaid leave. Where agreement cannot be reached, the employee is entitled to take up to two days unpaid leave. Where paid leave is available to the employee, the employer may require the employee to take such leave instead.
28.6 Variation of period of parental leave
Unless agreed otherwise between the employer and employee, an employee may apply to their employer to change the period of parental leave on one occasion. Any such change to be notified at least four weeks prior to the commencement of the changed arrangements.
28.7 Parental leave and other entitlements
An employee may in lieu of or in conjunction with parental leave, access any annual leave or long service leave entitlements which they have accrued subject to the total amount of leave not exceeding 52 weeks.
28.8 Transfer to a safe job
28.8.1 Where an employee is pregnant and, in the opinion of a registered medical practitioner, illness or risks arising out of the pregnancy or hazards connected with the work assigned to the employee make it inadvisable for the employee to continue at her present work, the employee will, if the employer deems it practicable, be transferred to a safe job at the rate and on the conditions attaching to that job until the commencement of maternity leave.
28.8.2 If the transfer to a safe job is not practicable, the employee may elect, or the employer may require the employee to commence parental leave for such period as is certified necessary by a registered medical practitioner.
28.9 Returning to work after a period of parental leave
28.9.1 An employee will notify of their intention to return to work after a period of parental leave at least four weeks prior to the expiration of the leave.
28.9.2 An employee will be entitled to the position which they held immediately before proceeding on parental leave. In the case of an employee transferred to a safe job pursuant to 28.8 hereof, the employee will be entitled to return to the position they held immediately before such transfer.
28.9.3 Where such position no longer exists but there are other positions available which the employee is qualified for and is capable of performing, the employee will be entitled to a position as nearly comparable in status and pay to that of their former position.
28.10 Replacement employees
28.10.1 A replacement employee is an employee specifically engaged or temporarily promoted or transferred, as a result of an employee proceeding on parental leave.
28.10.2 Before an employer engages a replacement employee the employer must inform that person of the temporary nature of the employment and of the rights of the employee who is being replaced.
29. JURY SERVICE
Subject to the production of satisfactory evidence, an employee required to be absent from work due to jury service will be reimbursed by the employer for any loss of wages to the extent of the difference between the amount the employee received for attendance on jury service and the employee's ordinary-time rate of pay during such absence.
30. PUBLIC HOLIDAYS
30.1 Employees on weekly hiring shall be entitled to the following public holidays without loss of pay:
30.1.1 New Year's Day, Good Friday, Easter Saturday, Easter Monday, Christmas Day and Boxing Day; and
30.1.2 The following days, as prescribed in the relevant States, Territories and localities: Australia Day, Anzac Day, Queen's Birthday and Eight Hours' Day or Labour Day; and
30.1.3 One other day on the day fixed as follows:
30.1.3(a) Northern Territory: The day shall be Picnic Day.
30.1.3(b) Queensland: The day shall be Exhibition Day.
30.1.3(c) Victoria: The day shall be Melbourne Cup Day.
30.1.3(d) New South Wales: The day shall be August Bank holiday.
30.1.3(e) Western Australia: The day shall be Foundation Day (State).
30.1.3(f) Tasmania: The day shall be Regatta Day in southern Tasmania and Recreation day in northern Tasmania.
30.1.3(g) South Australia: The day shall be Adelaide Cup Day.
30.1.3(h) Australian Capital Territory: The day shall be Canberra Day.
30.2 Days in lieu
30.2.1 When Christmas Day is a Saturday or a Sunday, a holiday in lieu thereof shall be observed on 27 December.
30.2.2 When Boxing Day is a Saturday or a Sunday, a holiday in lieu thereof shall be observed on 28 December.
30.2.3 When New Year's Day or Australia Day is a Saturday or Sunday, a holiday in lieu thereof shall be observed on the next Monday.
30.3 Where in a State, Territory or locality, public holidays are declared or prescribed on days other than those set out in 30.1 and 30.2 hereof, those days shall constitute additional holidays for the purpose of this award.
30.4 Holidays by agreement
An employer, with the agreement of the union, may substitute another day for any prescribed in this clause.
30.4.1 An employer and the employees may agree to substitute another day for any prescribed in this clause. For the purpose, the consent of the majority of affected employees shall constitute agreement.
30.4.2 An agreement pursuant to 30.4.1 hereof shall be recorded in writing and be available to every affected employee.
30.4.3 The union shall be informed of an agreement pursuant to 30.4.1 hereof and may within seven days refuse to accept it. The union will not unreasonably refuse to accept this agreement.
30.4.4 If a union, pursuant to 30.4.3 hereof, refuses to accept an agreement, the parties will seek to resolve their differences to the satisfaction of the employer, the employees and the union.
30.4.5 If no resolution is achieved pursuant to 30.4.4 hereof, the employer may apply to the Commission for approval of the agreement reached with his or her employees. Such an application must be made fourteen or more days before the prescribed holiday. After giving the employer and the union an opportunity to be heard, the Commission will determine the application.
30.5 An employee called upon to work on any of the holidays shall be notified the day before and, except as provided in 30.6 and 30.7 hereof, shall in addition to the weekly wage, be paid double time for all time worked with a minimum payment as for four hours.
30.6 If the employee is required to work on a holiday during hours which, if that day was not a holiday, would be outside the range of ordinary working time mentioned in clauses 21 Hours - day workers and 25 - Shift work of this award, the employee's hourly rate for such work shall be triple time.
30.7 The rates hereinbefore prescribed in this clause shall be in the case of all shift work be deemed to include all shift allowances prescribed in 25.8 of this award.
30.8 An employee notified to attend for work on a holiday which is not so worked shall be paid at holiday rates for four hours. Provided that this clause shall not apply where an employee who has already been notified to attend for work is given a minimum of 24 hours' notice that the employee is not so required.
30.9 Where an employee is absent from employment on the working day before or the working day after a holiday without reasonable excuse or without the consent of the employer, the employee shall not be entitled to payment for such holiday.
PART 8 - TRAINING AND RELATED MATTERS
31. RELATIONSHIP TO NATIONAL TRAINING WAGE AWARD 2000
A party to this award shall comply with the terms of the National Training Wage Award 2000, [PR904174 [AW790899]] as varied, as though bound by clause 4 of that award.
32. AWARD TO BE EXHIBITED
A copy of this award and any variations thereto shall be posted and kept posted in a prominent position in an accessible place in each yard or depot.
The employer shall permit access to or the erection of noticeboards to facilitate communication between employees and union representatives.
