Award variation.

ORDER

A. The above award is varied as follows:

1. By deleting clauses 11.3, 11.3.1, 11.3.2, 11.3.2(a), (b), (c) and (d) in their entirety and inserting in lieu thereof:

11.3 Casual employment (as defined in clause 6 - Definitions)

11.3.1 A casual employee is an employee engaged as such. A casual employee must be paid as follows:

11.3.2 In substitution for the rates prescribed in 11.3.1, a casual employee shall be paid the following special rates based upon the appropriate ordinary hourly rate applicable to permanent employees for work performed (from the beginning of the first pay period commencing on or after 1 November 2003):

14. WAGES

14.1 The minimum rates of pay of pharmacy assistants for a week of 38 hours shall be (from the first pay period commencing on or after 1 November 2003):

15. WORK STANDARDS AND CLASSIFICATION ARRANGEMENTS FOR PHARMACY ASSISTANTS

15.1 Limitation on work

15.1.1 Pharmacy assistants assist pharmacists in the provision of goods and services to the community.

15.1.2 Pharmacy assistants perform tasks, which support pharmacists in the discharge of the pharmacists' legal and professional responsibilities to the community.

15.1.3 Pharmacy assistants must undertake duties as directed within the limits of their competence.

15.1.4 Pharmacy assistants work under the direction and supervision of pharmacists.

15.2 Savings

Nothing in this award shall be deemed to be construed to:

15.3 A Pharmacy Assistant Competency level 1 first six months, is an employee who has commenced employment in a community pharmacy and is in the process of acquiring the competencies listed for Pharmacy Assistant Competency level 1.

15.4 A Pharmacy Assistant Competency level 1 is an employee who has acquired the competencies listed for Pharmacy Assistant Competency level 1 working in a community pharmacy.

15.5 A Pharmacy Assistant Competency level 2 is an employee who has acquired the competencies listed for Pharmacy Assistant Competency level 2.

15.5.1 Employees employed at the date of the making of this award may be classified by the employer at Pharmacy Assistant Competency Level 2 after two years, but if not so classified, the employer will arrange, at the employer's cost, for a Recognition of Prior Learning assessment to be conducted.

15.6 Junior rates of pay apply to Pharmacy Assistant Competency level 1 first six months, Pharmacy Assistant Competency level 1 and Pharmacy Assistant Competency level 2.

15.7 A Pharmacy Assistant Competency level 3 is an employee who has acquired the competencies listed for Pharmacy Assistant Competency level 3 and who is required by the employer to work at this level.

15.8 A Pharmacy Assistant Competency level 4 is an employee who has acquired the competencies listed for Pharmacy Assistant Competency level 4 and who is required by the employer to work at this level.

15.9 Where units of competence are referred to below, they relate to the Community Pharmacy Competency Standards in the Community Pharmacy Training Package endorsed by the Australian National Training Authority in February 2002.

16.2 Pharmacy assistant competency level 2

17. CLASSIFICATION PROCESS

17.1 All employers are required to classify their employees according to the classification structure. This classification process will take into account the levels of competency of pharmacy assistants when assessed against the competencies listed at Clause 16 - Competencies.

17.2 The new classification structure will come into effect from the first pay period on or after 1 November 2003. All employers are required to reclassify their employees according to the classification structure by 1 May 2004. This classification process will take into account the levels of competency of pharmacy assistants when assessed against the competencies listed above.

17.3 In classifying employees, evidence of competency at the various levels will be satisfied if the employee possesses the relevant qualification issued following successful completion of training from the Community Pharmacy Training Package at a particular level, or following a Recognition of Prior Learning (RPL) assessment conducted by a qualified assessor.

17.4 The Community Pharmacy Training Package has been developed to meet the specific needs of community pharmacy. Qualifications are issued in accordance with the Australian Quality Training Framework.

17.5 Employees without the relevant qualification will often not have the skill levels indicated in the competency standards.

17.6 The relevant national qualifications at each competency level of pharmacy assistant are as follows:

17.6.4 Pharmacy Assistant Competency level 4

17.7 Transition Arrangements

B. This order shall come into force from the first pay period to commence on or after 1 November 2003 and shall remain in force for a period of 6 months.
