New training package.

ORDER

A. The above award is varied as follows:

1. By deleting the words "training agreement" appearing in clause 1.4.1 and inserting "Contract of Training" in lieu thereof.

2. By deleting the word "addition" appearing in clause 2.2.5(b) and inserting "additional" in lieu thereof.

3. By deleting clause 4.2.6(c)(i) and inserting the following in lieu thereof:

4.2.6(c)(i) Where it is consistent with State Legislation, an apprentice may be engaged under a Training Agreement or Contract of Training approved by the relevant State or Territory Authority, provided the qualification outcome specified in the Training Agreement or Contract of Training is consistent with that established for the vocation in the training package determined from time to time by the Manufacturing Industry Skills Council (MISC) or its successors and endorsed by the relevant Training Authority or, is consistent with the qualifications established for electrical vocations within the relevant electrical/utilities Training Package endorsed by the National Training Quality Council or its successor.

4. By deleting from clause 4.2.6(d)(iv) the words "Accreditation and Registration Council" and inserting "Training and Skills Commission" in lieu thereof.

5. By deleting from clause 4.2.6(h) the word "conduct" and inserting "progress" in lieu thereof.

6. By deleting from clause 4.2.8 the words "Interim Award 1994" and inserting "Award 2000" in lieu thereof.

7. By adding into 4.3.1(e) the following:

4.3.1(e)(vi) Termination provisions for Apprentices are provided by the relevant State or Territory Training Authority.

8. By deleting from clause 5.1.3(a) the words "Manufacturing, Engineering and Related Services Industry Training Advisory Body" and inserting "Manufacturing Industry Skills Council" in lieu thereof.

9. By deleting from clause 5.1.3(d)(ii) the words "should be approved by the Manufacturing, Engineering and Related Services Industry Training Advisory Body (MERSITAB)" and inserting "shall be approved by the Manufacturing Industry Skills Council" in lieu thereof.

10. By deleting from clause 5.3.1(d)(ii) all references to "MERSITAB" and inserting "Manufacturing Industry Skills Council" in lieu thereof.

11. By deleting 5.1.3(e)(i) in its entirety, and renumbering 5.1.3(e)(ii) and 5.1.3(e)(iii) as 5.1.3(e)(i) and 5.1.3(ii) respectively.

12. By deleting clause 5.4.1 and inserting the following in lieu thereof:

5.4.1 Where a person was employed by an employer under this award immediately prior to entering into a Contract of Training or Training Agreement as an adult apprentice with that employer, such person shall not suffer a reduction in the rate of pay by virtue of entering into a Contract of Training or Training Agreement.

13. By deleting from clause 5.6.1 the words "National Training Wage Interim Award 1994" and inserting "National Training Wage Award 2000" in lieu thereof.

14. By deleting from clause 5.6.2(a) the words"National Training Wage Interim Award 1994" and inserting "National Training Wage Award 2000" in lieu thereof.

15. By deleting from clause 5.6.2(b) the words "Manufacturing, Engineering and Related Services Industry Training Advisory Body (MERSITAB)" and inserting "Manufacturing Industry Skills Council" in lieu thereof.

16. By deleting from clause 5.6.2(d) all references to "Manufacturing, Engineering and Related Services Industry Training Advisory Body (MERSITAB)" and "MERSITAB" and inserting "Manufacturing Industry Skills Council" in lieu thereof.

17. By deleting from clause 5.6.2(d) the words "and Jobsko".

18. By inserting into clause 1.2 of Schedule D a fourth dot point in the Note as follows:

• Clause 5.1.3(f) Points

19. By inserting into clause 1.2 of Schedule D, at the end of WAGE GROUP: C7, the word "of" between the words "not" and "itself" appearing in the `NB' notation.

20. By deleting from clause 1.2 of Schedule D, WAGE GROUP: C2(b) under the heading "Or equivalent", at point (i), the words "Manufacturing, Engineering and Related Services Industry Training Advisory Body (MERSITAB)" and inserting "Manufacturing Industry Skills Council" in lieu thereof.

21. By deleting from clause 1.2 of Schedule D, WAGE GROUP: C2(b) under the heading "Or equivalent" at point (ii) the acronym "MERSITAB" and inserting "Metal and Engineering" in lieu thereof.

21. By deleting from clause 1.2 of Schedule D, WAGE GROUP: C2(b) under the heading "Work within the scope of this level", the words "MERSITAB competency standards" and inserting "Metal and Engineering Competency Standards as developed and maintained by Manufacturing Industry Skills Council or its successor" in lieu thereof.

B. This order shall come into force from the first pay period to commence on or after 17 January 2005 and shall remain in force for a period of three months.
