35. AWARD BENEFITS TO BE CONTINUOUS

(i) In the event of any change in ownership, licensee or management of any facility covered by this award, all employee rights and benefits provided by this award shall continue as if no such change in ownership, licensee or management had taken place.

(ii) Where such changes do occur, no employee shall be paid out for accrued annual leave, long service leave, or any other benefit, but such benefit shall be continuous.

(iii) No full-time or permanent part-time employee shall be terminated or required to take leave without pay, where such termination or leave is used to avoid the requirements of any Act or to avoid payment of any rights or benefits provided by this award.
