AN120011 – Aged Care General Services (State) Award

39. AREA, INCIDENCE AND DURATION

(i) This award was made following a review under section 19 of the Industrial Relations Act 1996. This award rescinds and replaces the Aged Care General Services (State) Award published 16 September 1994 (281 I.G. 924) as varied and the Aged Care Services Rates of Pay (State) Award published 4 October 1996 (295 I.G. 105) as varied.

(ii) This award shall apply to:

(a) all nursing homes required to be licensed under the Nursing Homes Act 1988, which are operated as commercial undertakings;

(b) (1) the following residential centres for the aged (i.e. aged care hostels) operated as commercial undertakings, licensed or exempt from licensing under the Community Services Act 1973:

Carey Bay Hostel, 2 Laycock Street, Carey Bay; Dalton Gardens, 678 Victoria Road, Ryde;
Noreen Phyllis Cottage, 87 Bland Street, Ashfield; Scenic Lodge, Scenic Drive, Merewether;
The Pines Apartments, 42 Booralie Road, Terry Hills;

Toronto Hostel, Worhurst Avenue, Toronto; and

(2) the following residential centres for the aged (i.e. aged care hostels) operated as charitable or non-profit-making undertakings:

A H Livingston House, Grafton; Arthur Webb Court Hostel, Glenfield; Birrungan Lodge Hostel;
Easton Park Hostel Units, Glenfield; Easton Park New Hostel Units, Glenfield; Greenstone Lodge, Temora;
Ilumba Gardens, Kelso; Kyogle Court, Kyogle;
Lake Macquarie Retirement Village Hostel, Belmont; Laurieton Haven Hostel, Laurieton;
Lower Clarence Retirement Village Hostel, Maclean; Maas House, Glenfield;

Masonic Towers, Hornsby;

Namoi Valley Aged Care Hostel; Primrose Court;
Redhead Gardens Hostel;

The Noel Warren Masonic Village; Wingham Court, Wingham;
with respect to employees employed prior to 4 September, 1998, to the extent that this award provides any benefit or benefits greater than the benefits contained in the Charitable Sector Aged and Disability Care Services (State) Award, published 16 September 1994 (281 I.G. 1011), as varied, then such greater benefit or benefits in this award shall apply.

(c) (1) the following retirement villages, operated as commercial undertakings which are attached to or have a nursing home located within their grounds:

Berkeley Village Nursing Centre, Lot 4 Lorraine Avenue, Berkeley Vale; Blakehurst Serviced Apartments and Villas, Cheddar Street, Blakehurst; Edgewood Park Nursing Centre,269 Beach Road, Denham's Beach; Endeavour Nursing Centre, 79 Hawkesbury Road, Springwood;
Glenmere Nursing Centre, Lot 6 Wahroonga Road, Kanwal;

Hillside Nursing Centre, Lot 2 Violet Town Road, Mount Hutton; Homewood Aged Care, 64 Ilisse Street, Bexley;

Killarney Vale Nursing Centre, 1 Daniel Close, Killarney Vale; Seaside Nursing Centre, 184 Garden Street, Warriewood;
Tweed Heads Nursing Centre, Carramar Drive West, Tweed Heads; and

(2) the following retirement villages, operated as charitable or non-profit undertakings: Easton Park Retirement Village, Glenfield;
Frank Whiddon Masonic Homes, Glenfield; Ilumba Gardens Retirement Village, Kelso; Lake Macquarie Retirement Village; Laurieton Haven Home for the Frail Aged; Lower Clarence Retirement Village; Maitland Retirement Village;

with respect to employees employed prior to 4 September, 1998, to the extent that this award provides any benefit or benefits greater than the benefits contained in the Charitable Sector Aged and Disability Care Services (State) Award published 16 September, 1994 (281 I.G. 1011), as varied, then such greater benefit or benefits in this award shall apply.

(d) the following nursing homes licensed under the Nursing Homes Act 1988 which are operated as voluntary, religious, charitable and other non-profit making private nursing homes, whilst ever they are exempt from the Charitable Sector Aged and Disability Care Services (State) Award:

(e) the Grand United Centenary Centre Nursing Home with respect to employees employed prior to 15 July 1997, to the extent that this award provides any benefit or benefits greater than the benefits contained in the Charitable Sector Aged and Disability Care Services (State) Award, published 16 September 1994 (281 I.G. 1011), as varied, then such greater benefit or benefits in this award shall apply.

(f) the following nursing homes, however named: Clarence Nursing Home, Grafton;
Frank Whiddon Masonic Nursing Home, Glenfield; The Cedars Nursing Home, Casino;
Wingham Court Nursing Home, Wingham;

Narraburra Lodge Nursing Home, Temora (previously Greenstone Lodge Nursing Home, Temora);

with respect to employees employed prior to 4 September, 1998, to the extent that this award provides any benefit or benefits greater than the benefits contained in the Charitable Sector Aged and Disability Care Services (State) Award published 16 September 1994 (281 I.G. 1011), as varied, then such greater benefit or benefits in this award shall apply.

(g) and to all persons employed by or in or in connection with such nursing homes, residential centres for the aged/aged care hostels and retirement villages, specified in (a), (b), (c), (d), (e) and (f) above, who come within the constitution rule of the Health Services Union; in the State, excluding the County of Yancowinna. in the State, excluding the County of Yancowinna.

(iii) This award shall take effect on and from 17 July 2000 and shall have a nominal term of twelve months.
