AN150038 – Clerks (Retail Industry) Award
CLAUSE 1.3 SCOPE, PERSONS BOUND AND LOCALITY
OPDATE 12:03:2004 on and from
1.3.1 This Award applies throughout the State of South Australia to persons employed in the occupations of clerks and other clerical and office workers whose classifications are set out in Schedule 1 and who are employed by an employer whose principal business is the sale of goods by retail.
1.3.2 Exemptions
1.3.2.1 This Award does not apply to an employer who is a member of the Motor Trade Association of South Australia or to an employer who is a member of the Motor Trade Association of South Australia where that employers operations are principally concerned with occupations governed by:
(a) the Vehicle Industry (South Australia) Repair, Service and Retail Award, being an Award of the Industrial Commission;
(b) the Vehicle Industry - Repair, Services and Retail - Award 2002, being an Award of the Australian Industrial Relations Commission;
(c) the Rubber, Plastic and Cable Making Industry General Award 1998, being an Award of the Australian Industrial Relations Commission; or
(d) The Vehicle Industry Award 2000, being an Award of the Australian Industrial Relations Commission.
1.3.2.2 Clerical employees covered by 1.3.2.1 will continue to have the terms and conditions of their employment governed by the Clerks (South Australia) Award.
1.3.2.3 The exemption in 1.3.2.1 does not apply to the operations of K Mart (South Australia). Clerks employed by K Mart (South Australia) will have the terms and conditions of their employment governed by the Clerks (Retail Industry) Award.
