AN150038 – Clerks (Retail Industry) Award

CLAUSE 1.5 DEFINITIONS

In this Award, except where otherwise indicated:

1.5.1 Act means the Fair Work Act 1994.

1.5.2 Casual employee means an employee who is employed on a contract of hire which is less than weekly.

1.5.3 Central Shopping District means the portion of the municipality of the Corporation of the City of Adelaide that lies within the Hundred of Adelaide.

1.5.4 Clerk means any person covered by this Award.

1.5.5 Commission means the Industrial Relations Commission of South Australia.

1.5.6 Continuous service means service as provided for in clause 1.6.

1.5.7 Establishment which does not trade after 12:30pm on Saturday in any given week means a shop which is closed and fastened against the admission of the public by no later than 12.30pm on Saturday and for the remainder of that Saturday after 12.30pm.

1.5.8 Full-time employee means an employee who is engaged by the week for an average of 38 hours a week, provided that where the normal full-time hours for a particular workplace covered by this Award are less than an average of 38 then that is the number of hours regarded as full-time.

1.5.9 Metropolitan Shopping District means the portion of the metropolitan area that is not comprised of the Central Shopping District.

1.5.10 Part-time employee means an employee who is engaged by the week for not less than 15 hours per week nor more than 37.5 hours per week provided that where the normal full time hours in a particular workplace for employees covered by this Award are less than 38 hours per week, the maximum part time hours shall be one half hour less than the normal full time hours of work. Provided that where an individual employee requests and the employer agrees, the minimum engagement in any week may be less than 15 hours, but not less than 7.6 hours.

1.5.11 Union or Union(s) means the Amalgamated ASU (SA) State Union (Australian Services Union) and/or the Shop, Distributive and Allied Employees' Association, South Australian Branch.

1.5.12 Weeks pay means the ordinary time rate of pay for the employee concerned as prescribed in clause 4.5.1.

1.5.13 Subject to clause 4.3.2 ordinary hourly rate means the weekly rate for ordinary hours of work for a full time employee as prescribed in Schedule 2 for the employees classification divided by 38.
