AN150039 – Clerks' (South Australia) Award

CLAUSE 3.2 DISPUTE AVOIDANCE / GRIEVANCE PROCESS

Any industrial dispute or claim arising out of or relating to this Award must be dealt with in the following manner:

3.2.1 As soon as is practicable after the dispute or claim has arisen, the employee concerned must take the matter up with their immediate supervisor affording that supervisor the opportunity to remedy the cause of the dispute or claim.

3.2.2 Where any such attempt at settlement has failed, or where the dispute or claim is of such a nature that a direct discussion between the employee and the immediate supervisor would be inappropriate the employee may notify a representative of the Union or other representative of the employees choice, who, if that representative considers that there is some substance in the dispute or claim, will forthwith take the matter up with the employer or the employer’s representative.

3.2.3 If the matter is not settled it may be submitted to the Commission for resolution.

3.2.4 Without prejudice to either party, work should continue in accordance with the Award while the matters in dispute are being dealt with in accordance with this Clause.
