AN170010 – Building and Construction Industry Award

48. APPRENTICES

(a) Except as provided in this subclause, this award shall apply to the employment of any apprentice in any trade subject to the provisions of the Tasmanian Vocational Education and Training Act 1994.

(b) The minimum ordinary rate of pay to be paid per week to apprentices shall be in accordance with the percentage set out below (calculated to the nearest 10 cents, less than five cents to be disregarded) applied to the aggregate of the appropriate tradespersons minimum weekly rate (i.e. base rate plus supplementary payment plus arbitrated safety net) prescribed in subclause 13(a) and the special allowance prescribed in subclause 13(e) of this award:

(d) In addition to the above rates apprentices shall receive the appropriate amounts prescribed in Clause 20 - Industry Allowance, Clause 21 - Underground Allowance and Clause 22 - Tool and Boot Allowances of this award, as part of the ordinary weekly wage for all purposes.

(e) Except where inconsistent with the Tasmanian Vocational Education and Training Act 1994 the general provisions of this award shall apply to apprentices employed on work subject to the scope of this award by respondent employers to the award.

(f) An employer may, by agreement with the apprentice’s parent or guardian, elect to provide the apprentice with a kit of tools and, subject to establishing the value of the tools at the time of so providing, deduct the tool allowance until the cost of the kit of tools is reimbursed.

(g) In the event of an apprentice being dismissed or leaving employment before the cost of the tool kit has been reimbursed the employer shall be entitled to:
