10.1 Notice of termination by employee
An employee, other than a casual employee, is required to give an employer a minimum of two weeks notice of an intention to terminate their employment.
10.2 Notice of termination by employer
10.2.1 An employer must not terminate the employment of an employee unless the employee is given 8 weeks notice of such termination.
10.2.2 An employer and an employee may by agreement convert some or all of the notice period given in accordance with 10.2.1 to payment in lieu.
10.2.3 Notwithstanding the provisions in clause 10.2.1 an employer may terminate the employment of a casual employee by giving one hours notice.
10.2.4 Time off during notice period
Where an employer has given notice of termination to an employee, other than a casual, the employee must be allowed to take up to one day off work without loss of pay to seek alternative employment.
10.2.5 Summary dismissal
The period of notice shall not apply to an employee dismissed for misconduct, including serious and wilful misconduct or gross neglect of duty. In such cases the wage will be paid up until the time of dismissal only.
