27. LONG SERVICE LEAVE

27.1 Entitlement

An employee will be granted long service leave as follows:

Years of Service

Amount of Long Service Leave

   

10 years of completed service

3 months paid leave

27.2 Long Service Leave accrues at the rate of 1.3 weeks per year of service.

27.3 An employee is entitled to take any or all of his/her entitlement at half pay for twice the period.

27.4 Rate of pay during long service leave

An employee on long service leave with full pay will be paid as follows:

27.4.1 Where all the employee's service has been full-time, payment is at the normal full-time salary.

27.4.2 Where all the employee's service has been part-time, payment during long service leave is calculated as follows:

27.4.2(a) where the time fraction has been constant, payment is made at that time fraction.

27.4.2(b) where the time fraction has been varied, payment is based on the average time fraction, calculated over total period of service.

27.4.3 Where the service includes both full-time and part-time service, the long service leave credit is split into two categories, one representing the aggregate full-time service and one representing the aggregate part-time service.

27.4.4 Payment during long service leave will be made in accordance with 27.4, depending on whether the employee chooses to utilise his/her full-time or part-time credit in relation to any particular long service leave absence.

27.4.5 For the purpose of clause 27.4, only service since 23 May 1996 can be taken into account in computing the rate of pay.

27.5 Transfer of service

Subject to 27.5.2 service with any other respondent to this award is transferable for the purposes of computing service for long service leave.

27.5.1 Service with a previous employer is transferable for the purpose of computing service for Long Service Leave where both employers are respondents to this award and the break in service between the two employers does not exceed 12 months, or the break in service is greater than twelve months and the Committee agrees to recognise such service.

27.5.2 Where service with another employer is recognised for the computation of long Service Leave by the Committee, a period of not less than three years service with the current employer must be completed before the employee is eligible to take Long Service Leave.

27.6 An employee, or where applicable his or her legal representative, after 3 years service with that employer must be paid in lieu for Long Service Leave accrued but not taken as at the date of termination of service where the accumulated period of recognised service is 5 years or more. Calculation for such payment must be in accordance with clause 27.4.

27.7 An employee is entitled to take long service leave in conjunction with other forms of approved leave. Such leave is subject to the employer's agreement where the total period of leave would exceed 12 months.

27.8 Unless agreed by the employer an employee must give six months notice of intention to take long service leave.

27.9 Long Service Leave credits can be partially exhausted provided that the period of leave is at least one month on normal pay or two months on half pay.

27.10 Salary during Long Service Leave is paid as usual unless the employee requests a lump sum payment in advance.

27.11 Where a public holiday occurs during the period that an employee is absent on Long Service Leave and such holiday is observed by the Committee no deduction is to be made for that day from the Long Service Leave credits of the employee.

27.12 Although approved leave without pay is not counted as time worked for the purposes of calculating long service leave credits, it must be recognised as establishing the continuous employment of the employee.

27.13 Any period of paid leave must be counted as service for determining entitlement to long service leave.

27.14 Where an employee with accrued sick leave credits is ill whilst on long service leave, the employee must be placed on sick leave and no deduction is to be made from long service leave credits for those days. Evidence of illness must be provided in accordance with clause 24.4.
