5.3 EMPLOYEES COVERED BY FORMER PAID RATES AWARD

5.3.1 The provisions of Schedule 2, Part 2 only apply to an Aboriginal Legal Rights Movement Inc. employee who was in employment with the Aboriginal Legal Rights Movement of SA Inc. prior to the 28 March, 2001, the date when the Award was converted from a paid rates award to a minimum rates award - an ‘eligible employee’.

5.3.2 Where an eligible employee had an award entitlement to a higher award wage rate immediately prior to the 28 March, 2001, the date when this award was converted to a minimum rates award, that higher rate will apply. The provisions of Schedule 2, Part 2 set out the pay rates which applied and the associated provisions which determined the appropriate pay point for employees. By applying these provisions to eligible employees, the appropriate pay point which applied to an employee immediately prior to 28 March 2001 can be determined. Where the award wage rate determined in accordance with Schedule 2, Part 2 is higher than the minimum rate for the classification level as set out in Schedule 2, Part 1, the higher wage rate will apply to an eligible employee while the rate remains beneficial to the employee. Where a rate in Schedule 2, Part 2 is lower than the relevant minimum rate in the award as set out in Schedule 2, Part 1, the rate has an asterisk against it to show that the rate is no longer beneficial to eligible employees.

5.3.3 In accordance with the Paid Rate Review decision of 20 October, 1998 [Print Q7661], any future increases in wage rates in the award will only apply to the minimum rates and will be offset against any residual amoun0t shown.
