PART 3 – CONSULTATION, COMMUNICATION AND DISPUTE RESOLUTION 

11. DISPUTE RESOLUTION

In the event of a dispute arising, the procedure to be followed to resolve the matter will be as follows:

11.1 The employee/s and the supervisor will meet and confer on the matter.

11.2 If the matter is not resolved at such a meeting, the parties will arrange for further discussions between the employee/s and the relevant union or a nominated representative, if any, and more senior levels of management.

11.3 If the matter is still not resolved, the parties will arrange for further discussions between the relevant union or an employee’s nominated representative, if any, and more senior levels of management.

11.4 If the matter cannot be resolved, it may be referred to the Australian Industrial Relations Commission.

11.5 While the parties attempt to resolve the matter, work will continue as normal unless the employee/s has a reasonable concern about an imminent risk to their health and safety.

11.6 At any time during the above steps, the employee may choose to be represented by the relevant union delegate/official or other employee representative.

11.7 To assist in dispute resolution, a union delegate/employee representative, referred to in 11.6 will be granted leave of absence to attend short courses which are specifically directed towards effective dispute resolution. These courses must be conducted by a recognised training provider. The grant of leave to attend a course will be subject to operational requirements.

11.7.1 The specific training course will be agreed between the employer and the individual employee.

11.7.2 A union delegate/employee representative granted leave of absence under 11.7 will not suffer any loss of pay.

11.8 To assist in the dispute resolution process, the union delegate /employee representative, referred to in 11.2, will be granted leave of absence to attend proceedings arising from a referral of the matter in 11.4. Provided that the steps/process outlined above have been complied with. A union delegate/employee representative granted leave of absence will not suffer any loss of pay.
