15. EMPLOYMENT CATEGORIES

15.1 Probationary Employment

15.1.1 An ongoing employee may be initially engaged on probation for a period not exceeding three months for the purpose of determining the employee’s suitability for ongoing employment. This period may be longer where the position involves a formal period of training exceeding three months followed by a formal assessment mechanism.

15.1.2 The employee will be advised prior to commencement of employment of his or her probationary status and the length of probation.

15.1.3 Unless the employee is advised otherwise, he or she will become an ongoing employee at the completion of the probationary period.

15.1.4 The period of probation forms part of the employee’s continuous service.

15.2 Ongoing Employment

An employee will hold ongoing employment either on appointment or on satisfactory completion of the period of probation.

15.3 Full-time Employment

Any employee not specifically employed on a part-time or casual basis is for all purposes of this Award a full-time employee.

15.4 Casual Employment

15.4.1 A casual employee is a person employed on an irregular, intermittent and hourly basis without any ongoing commitment from either party as to an ongoing relationship.

15.4.2 A casual employee will be paid the relevant hourly rate of pay applying to an ongoing employee in the same classification. He or she will also be paid a casual loading of 15%.

15.5 Regular Part-time Employment

15.5.1 An employee may be engaged to work on a part-time basis involving a regular pattern of hours.

15.5.2 Regular part-time employees will receive, on a pro-rata basis, equivalent pay and conditions to those of a full-time employee, except where a condition is inconsistent with this section.

15.5.3 Part-time employees will be classified in accordance with 23 - Classifications and work level descriptions and will receive on a pro-rata basis equivalent pay and conditions to those of a full time employee.

15.5.4 Ordinary part-time hours will be a minimum of 3 consecutive hours.

15.5.5 An unpaid meal break will not be regarded as breaking the continuity of service.

15.5.6 Before commencing part-time employment, the employee and employer will agree in writing upon:

15.5.7 The agreed part-time hours will not be changed without the written consent of the employee, except that the initial written agreement may provide for the hours to be varied to full-time hours on a specific date.

15.5.8 Part-time employees who would have ordinarily worked on a particular day, had it not been a public holiday, will be paid as if he or she worked the ordinary part-time hours.

15.5.9 Part-time employees who work outside of the agreed part-time hours will be entitled to payment at overtime rates in accordance with 27 - Overtime.

15.5.10 A part-time employee who is appointed as a full-time employee may elect to have any unused leave entitlement accrued while employed part time converted to the full-time equivalent.

15.6 Fixed Term Employment

15.6.1 A fixed term employee may be engaged on a full-time or part-time basis for a specific task/s or project.

15.6.2 The details of the specific task/s or project will be set out in writing and retained by the employer. The employer will provide a copy to the employee.

15.6.3 An employee engaged in accordance with this clause is for all purposes of this Award a full-time or part-time employee, except where otherwise specified in this Award.

15.6.4 Employment under this clause, for a specific task/s will form part of an employee’s period of continuous service, where the employee is engaged as a full-time or part-time employee immediately following such an appointment.
