PART 7 - LEAVE OF ABSENCE AND PUBLIC HOLIDAYS 

32. ANNUAL LEAVE

32.1 Annual Leave Credits

32.1.1 An employee will receive four weeks annual leave for each completed year of service.

32.1.2 A shift worker will receive an additional credit of 1/10 of an ordinary working week for each Sunday or Public Holiday worked in each year of service. These credits cease to accrue when the employee has accrued one additional week’s leave.

32.1.3 Employees who work in remote or isolated localities are entitled to additional leave as set out below:

32.2 Excess Leave Credits

32.2.1 Accrued annual leave credits will be available to the employee for a period of two years and three months.

32.2.2 Where an employee has accrued leave credits in excess of 2 years the employee must apply for a period of annual leave equal at least to the excess credit. This application will occur within three months of the accrual of excess annual leave. The employer will advise the employees of the excess leave and grant any leave application in these circumstances.

32.2.3 If the employer is unable to grant an employee’s application for annual leave in these circumstances, the employee and the employer will agree on a substitute period within 9 months of the accrual of excess leave credits.

32.2.4 Where an employee has not applied for annual leave to cover excess credits within 2 years and 3 months, the employer may direct the employee to take annual leave.

32.3 Payment in lieu

32.3.1 When an employee ceases employment Airservices will pay the employee for all accrued annual leave at the rate of the employee’s salary on the date of cessation.

32.3.2 If an employee dies the amount set out above will be paid to the employee’s dependants or estate.
