AP772288 - CSIRO (Salaries and Conditions of Service) Award 1999
24.1 Entitlement: A full-time employee, except as provided in 24.1.3 and 24.1.4, accrues sick leave credits for absence due to personal illness in the following manner:
24.1.1 10 days full pay and 10 days at half pay sick leave on appointment and on completion of each 12 month period of service.
24.1.2 sick leave credits will be cumulative.
24.1.3 an employee appointed for a specified term of less than 12 months accrues sick leave credits following the completion of 44 days service. Sick leave which may then be granted is at the rate of 1 day for each 22 days service, subject to a limit of 5 days.
24.1.4 an employee in receipt of workers compensation for more than 45 weeks will accrue sick leave on the basis of hours actually worked.
24.2 Effect of leave without pay: Absences on leave without pay which do not count for service defer the next accrual by the number of completed months of absence. Absences of less than 1 calendar month are ignored, except where the aggregate of these absences is equal to or greater than 22 working days in the sick leave year. In such cases the accrual date is deferred by 1 calendar month for every 22 days.
24.3 Grant: When an employee is medically unfit for duty, leave of absence with pay may be granted subject to available credits:
24.3.1 on production of satisfactory medical evidence.
24.3.2 without production of a medical certificate, to the extent of 5 days in any sick leave year. No more than 3 consecutive days may be taken without a medical certificate.
24.4 Notice: Where practicable, the employee must give notice prior to the absence of the intention to take sick leave or otherwise notify of such absence at the first opportunity on the day of absence.
24.5 Public holidays: Sick leave will not be debited where an employee is medically unfit for duty on a public holiday which the employee would otherwise have observed.
24.6 Conversion to full pay: CSIRO may allow employees with long service to convert half pay sick leave credits to full pay sick leave credits, other than for short absences.
24.7 Sick leave without pay: Sick leave without pay may be granted where paid sick leave credits are exhausted.
24.8 Maximum: The maximum continuous period of sick leave will be 78 weeks, of which no more than 52 weeks may be paid sick leave. Leave of absence due to illness beyond 78 weeks does not count as service for any purpose.
24.9 Invalidity: An employee will not, without the employee's consent, be retired on invalidity grounds before the employee's full pay sick leave credit has expired, subject to the provisions of 24.8.
24.10 Sick on annual leave: An employee who is medically unfit for duty for one day or longer while on annual leave and who produces satisfactory medical evidence, may apply for sick leave. Annual leave will be re-credited to the extent of the period of sick leave granted.
24.11 Maternity leave: An employee will not be entitled to paid sick leave while also entitled to paid leave under clause 25.
