37 CEREMONIAL LEAVE

37.1.1 An employee who is legitimately required by the employee’s Aboriginal or Torres Strait Islander tradition to be absent from work for ceremonial purposes shall be entitled to up to 10 working days unpaid leave in any one year. The employee shall be able to establish to the employer that she or he has an obligation under Aboriginal and Torres Strait Islander custom and/or traditional law to participate in ceremonial activities shall be granted such leave without pay for a maximum period of 10 days per year or for such extension granted by the employer. Such leave shall not affect the employee’s entitlement to bereavement leave prescribed by clause 34 – Personal leave.

37.1.2 Approval of all Aboriginal Torres Strait Islander Ceremonial leave will be subject to the employer’s convenience and will not unreasonably affect the operation of the project concerned but shall not be unreasonably withheld.
