PART 6 - HOURS OF WORK, OVERTIME AND SHIFT WORK
18. HOURS
18.1 Ordinary hours of work
18.1.1 The ordinary hours of duty for employees will not exceed 38 hours per week and will be worked between the hours of 7.00 a.m. and 7.00 p.m. Monday to Friday.
18.1.2 However this spread of hours may be varied by agreement between the employer and the majority of employees in an enterprise or part of an enterprise.
18.1.3 The commencing and finishing times of employees working within the varied spread of hours will be agreed between individual employees and the employer.
18.1.4 Implementing 18.1.2 is subject to the employer informing the union at the particular enterprise of the intention to utilise this provision and providing a reasonable opportunity for the union to participate in negotiations. This requirement is subject to the union having members employed at the particular enterprise.
18.1.5 Once a decision has been made to use working arrangements made in accordance with this clause the terms must be set out in the time and wages records kept by the employer in accordance with Division 1 of Part A of the Workplace Regulations.
18.2 No employee will be required or permitted, to work more than five hours without a meal break of at least 30 minutes.
18.3 Make up-time
18.3.1 An employee may elect, with the consent of the employer, to work 'make up time' under which the employee takes time off during ordinary hours, and works those hours at a later time, during the spread of ordinary hours provided in this Award or where agreements have been reached under 18.1.2 and 18.1.3, within the spread of hours reached under 18.1.2.
18.3.2 An employee on shift work may elect, with the consent of their employer, to work “make-up” time under which the employee takes time off ordinary hours and works those hours at a later time, at the shift work rate which would have been applicable to the hours taken off.
