Employees Redundancy and Retrenchment Appendix

1. Preamble

1.1 On 15 March 2001, the NSW Supreme Court appointed provisional liquidators to HIH Insurance Limited and 17 of its related entities. Mr A.R.M. Macintosh and Mr A.G. McGrath from KPMG were appointed the provisional liquidators (the Provisional Liquidators). Amongst those 17 related companies was the main employing entity, HIH Casualty and General Insurance Limited (ACN 008 482 291).

1.2 This Appendix has been inserted into this Award to provide for retrenchment entitlements to HIH employees who are retrenched as part of the administration and programme of the provisional liquidation.

2. Scope, Application and Parties Bound by this Appendix

2.1 This Appendix binds each of the HIH companies listed in Table 1 to this Appendix, who are bound by the Award, being companies in respect of which the provisional liquidators were appointed on 15 March 2001 (together referred to as 'HIH') and the Finance Sector Union of Australia and all of its officers and members, employed by HIH.

2.2 This Appendix will not apply in respect of any person who was employed by HIH as at 15 March 2001 and for whom acceptable alternative employment was offered but not accepted and who thereafter ceased employment with HIH.

2.3 This Appendix will not apply in respect to any person who was employed by HIH as at 15 March 2001 and who subsequently accepted employment with NRMA Insurance Limited as a result of the acquisition by NRMA Insurance Limited of HIH's workers' compensation business. The persons to whom this subclause applies are listed in Table 2 to this Appendix.

2.4 This Appendix will not apply in respect of persons listed in Table 3 to this Appendix who were employed by HIH as at 15 March 2001 and who have a written employment agreement with HIH making provision for redundancy.

3. Date of Effect

Subject to clauses 2.2 and 2.3, this Appendix will operate from 15 March 2001.

4. NRMA exception

NRMA Insurance Limited having acquired part of the business operated by HIH subsequent to the operative date of this Appendix, it is ordered that, pursuant to section 149(1) of the Workplace Relations Act 1996 (Cth), this Appendix will not at any time bind NRMA Insurance Limited or its related entities.

5. Definitions

5.1 Redundancy occurs when an employer decides that the employer no longer wishes the job the employee has been doing to be done by anyone and this is not due to the ordinary and customary turnover of labour.

5.2 Retrenchment will mean the termination of employment as the result of redundancy.

5.3 Week's salary will mean actual wages for ordinary time including any shift allowance and weekend loadings applicable to such ordinary time. For an employee who is in receipt of a remuneration package, salary will mean the value of the total employment cost package.

6. Retrenchment entitlement

6.1 An employee who is retrenched is entitled to the following:

(i) 8 weeks' notice or payment in lieu of notice; and

(ii) a severance payment in respect of a continuous period of service of 3 weeks' salary for each year of continuous service or part thereof to a maximum of 65 weeks.

6.2 Provided that an employee who has service on both a full-time and part-time basis will have their entitlements calculated on a pro-rata basis, that is, on the actual time worked in each mode using that employee's current salary.

7. Acceptable Alternative Employment

7.1 The entitlement in Clause 6 will not apply to an employee where the employee has been offered acceptable alternative employment.

7.2 ‘Acceptable alternative employment’ means: employment on terms which, when considered as a whole, are no less favourable than those applying to the employee’s employment with HIH at the time of the offer; and employment on terms which transfers an employee’s continuous service with HIH to the new employer for purposes of accrued leave and severance.

8. Employee Leaving During Notice

An employee who is retrenched may terminate his or her employment during the period of notice and, if so, will be entitled to the same benefits and payments under clause 6 had they remained with HIH until the expiry of such notice. However, in this circumstance the employee will not be entitled to payment in lieu of notice.

9. Disputes

Any question concerning the interpretation, application or operation of this Appendix which can not be resolved by negotiation between the parties may be submitted to the Australian Industrial Relations Commission by either party in an endeavour to resolve the dispute by conciliation and/or arbitration.
