25. PUBLIC HOLIDAYS

25.1 Employees on weekly hiring shall be entitled to the following public holidays without loss of pay:

• New Year's Day
• Australia Day
• Good Friday
• Easter Saturday
• Easter Monday
• Queen's Birthday
• Labour Day
• Anzac Day
• Christmas Day
• Melbourne Cup Day (VIC)
• Adelaide Cup Day (SA)
• Boxing Day (Proclamation Day in SA)
• Union Picnic Day (Australian Capital Territory)
• Hobart Regatta Day (South of Oatlands) or first Monday in November (Where Regatta Day is not observed) (TAS only)
• Show Day (TAS)
• Canberra Day (Australian Capital Territory)

25.2 Additional public holidays in a State/Territory or locality

25.2.1 General

25.2.1(a) Where in a State or Territory or locality within a State or Territory an additional Public Holiday is proclaimed or gazetted by the authority of the Commonwealth Government or of a State or Territory Government and such proclaimed or gazetted holiday is to be observed generally by persons throughout the State or Territory or a locality thereof, other than by those covered by Federal Awards, or when such a proclaimed or gazetted day is , by any required judicial or administrative order, to be so observed then such day shall be deemed to be a holiday for the purposes of this award, for employees covered by this award who are employed in the State, Territory or locality in respect of which the holiday has been proclaimed or ordered as required.

25.2.1(b) By agreement between the employer and the employee, other days may be substituted for the said days.

25.2.1(c) Where an employee is absent on an ordinary working day before or after a Public Holiday without reasonable excuse or without the consent of the employer, the employee shall not be entitled to payment for such holiday.

25.2.2 In Victoria

For the purposes of this award, the following days shall be observed as public holidays within the State of Victoria:

25.2.2(a) When Christmas Day is a Saturday or Sunday, a holiday in lieu thereof shall be observed on 27 December

25.2.2(b) When Boxing Day is a Saturday or a pSunday, a holiday in lieu thereof shall be observed on 27 December.

25.2.2(c) When Christmas Day and Boxing Day fall on Saturday and Sunday respectively, a holiday in lieu thereof shall be observed on 27 and 28 December.

25.2.2(d) When New Years Day or Australia Day is a Saturday or Sunday, a holiday in lieu thereof shall be observed on the next Monday.
