5.1 For the purposes of this clause, a union representative shall mean a representative of the union employed as a teacher by the employer.
5.1.1 Any grievance or dispute including a dispute in relation to the performance of a teacher of his or her duties which arises shall where possible be settled by discussion at the workplace level between the teacher or teachers (as the case may be) and the employer.
5.1.2 In the case of dispute relating to performance the teacher shall:
5.1.2(a) be informed verbally or in writing, as appropriate of any complaints about, or problems relating to, the performance of his or her duties; and
5.1.2(b) be assisted to rectify such problems within a specified reasonable time frame,
5.1.3 If no agreement is reached between the teacher (or teachers) and the employer, and the teacher requests the union or the teacher’s nominated representative to discuss the dispute with the employer or nominated representative of the employer the following steps shall apply:
5.1.4 The union or the nominated representative shall be permitted in working hours (other than timetabled teaching time) to interview a representative of the college nominated for that person by the college in relation to a grievance or dispute. Such interview shall take place at a time and place convenient to both parties.
5.1.5 Nothing in this clause shall remove the right of a teacher or employer to refer a dispute to the Australian Industrial Relations Commission. Wherever possible, such notification should not occur until the procedures set out above have been exhausted.
