8. SUPERANNUATION

8.1 Definitions

For the purposes of this clause:

8.1.1 Basic Earnings means the total minimum salary rate prescribed from time to time in clause 7 - Salaries.

8.1.2 Fund means:

8.1.2(a) The NGS Super (hereafter called the Industry Fund); or

8.1.3(b) Any established fund receiving employer contributions as at the date of making this award; or

8.1.3(c) Any other fund that complies with the provisions of the Occupational Superannuation Standards Act and Regulations as mutually agreed between the employer and the majority of teachers.

8.1.3 Eligible Employee means a teacher who has completed not less than twenty days continuous service at the relevant college and is engaged to work for ten hours or more per week and who joins a Fund.

8.2 Contributions

8.2.1 Except as provided in 8.2.3 and 8.2.4 of this subclause, each College in respect of each eligible employee employed by it, shall pay contributions to the appropriate fund at the rate of three per cent of the teacher’s basic earnings.

8.2.2 Contributions shall be paid at intervals and in accordance with the procedures and subject to the requirements of the relevant Fund.

8.2.3 A College shall not be required to make contributions pursuant to this clause for any period when a teacher is absent without pay.

8.2.4 A College shall make contributions in respect of all days worked at the College by an eligible employee including the first twenty days of continuous service. Provided that where the College has complied with 9.3(a) and the teacher fails to join the relevant Fund within six weeks of being so informed, the College will only be obliged to make contributions calculated from the first pay period commencing on or after the date the teacher joins the Fund.

8.2.5 No contribution shall be payable in respect to any service by an eligible employee prior to the operative date of this award.

8.2.6 No College shall be required to make contributions into more than one fund. Any dispute in relation to this matter (including choice of fund) shall be handled pursuant to clause 5 - Grievance procedures.

8.3 Enrolment

8.3.1 Each College shall as soon as practicable as to both current and future eligible employees:

8.3.1(a) Notify in writing each employee of the entitlement to Occupational Superannuation.

8.3.1(b) Take all reasonable steps to ensure that each employee receives, completes, signs and returns the necessary application forms provided by the employer to enable that employee to become a member of the Fund.

8.3.1(c) Submit all completed application forms and any other relevant material to the Trustee/s of the Fund.

8.3.2 Each employee upon becoming eligible to become a member of a Fund shall:

8.3.2(a) Complete and sign the necessary application forms to enable that employee to become a member of that Fund.

8.3.2(b) Return such forms to the employer within 28 days of receipt in order to be entitled to the benefit of the contributions prescribed herein.
