5.1 Who is bound by this award
This award is binding upon:
(a) the employers listed in Schedule 1 of this award, in respect of persons employed as teachers who are eligible to be members of the Independent Education Union of Australia, whether or not those teachers are members of the union; and
(b) the Independent Education Union of Australia.
5.2 Transmission of business
5.2.1 Where a business is before or after the date of this award, transmitted from an employer (in this subclause called the transmittor) to another employer (in this subclause called the transmittee) and a teacher who at the time of such transmission was an employee of the transmittor in that business becomes an employee of the transmittee, then:
(a) the continuity of the employment of the teacher will be deemed not to have been broken by reason of such transmission; and
(b) the period of employment which the teacher has had with the transmittor or any prior transmittor will be deemed to be service of the teacher with the transmittee.
5.2.2 In this subclause business includes trade, process, business or occupation and includes part of any such business and transmission includes transfer, conveyance, assignment or succession whether by agreement or by operation of law and transmitted has a corresponding meaning.
