AP805733 - Commercial Travellers (A.C.T.) Award 2000
For the purpose of this award the following definitions shall apply:
4.1 AIRC means the Australian Industrial Relations Commission.
4.2 Union means National Union of Workers
4.3 Commercial traveller means a person employed, substantially away from the employer's place of business, for the purpose of soliciting orders for, or selling articles, goods, wares, merchandise or material for wholesale sale; for resale; or for use in or in connection with the production and/or preparation and/or distribution of commodities for sale by the customer.
Commercial traveller shall include all persons covered by the definition whether remunerated wholly or partly by commission or otherwise and whether employed wholly or partly on a commission basis or otherwise.
4.3.1 Local traveller means a commercial traveller who is not required by their employer to remain away from their usual place of residence for more than 54 consecutive hours in any one week of seven days. If a local traveller is required to remain away for more than 54 consecutive hours in any one week of seven days, the local traveller shall be regarded as a country traveller for that week.
4.3.2 Country traveller means a commercial traveller who is required by their employer to remain away from their usual place of residence for more than fifty-four consecutive hours.
4.3.3 Unless the context otherwise requires, Local traveller and Country traveller shall include a probationary traveller.
4.4 Wholesale Merchandiser shall mean a person employed to promote business of whatsoever kind, or conduct market research and enquiry, in retail stores including the preparation of display units, gondola ends and other areas where promotion of business is required and may include, as a minor feature of the work, the taking of orders but excluding the stacking of shelves in a shop except in an emergency other than persons employed by a bread manufacturer in a retail store.
4.5 Remuneration means the weekly amount payable to the Commercial Traveller in accordance with clause 18 - Classifications and wage rates.
4.6 Commission means any financial incentive payment, financial bonus or financial reward directly related to the soliciting or obtaining of orders or business by the Commercial Traveller which is additional to the remuneration payable in accordance with clause 18 - Classifications and wage rates.
4.7 Territory, for the purposes of this award, shall be deemed to include the geographic boundaries or any lists of persons, or any combinations thereof, from where or from whom the traveller is required by their employer to solicit or obtain orders.
4.8 Act means the Workplace Relations Act 1996
